4 Actions and Where You Can Object
How MCA Funders Domesticate a New York Judgment in Your Home State

A New York judgment gains force in another state only through that state procedure. Texas, Florida, and California run different clocks from different events, and each objection belongs in the receiving court.

A New York MCA judgment does not enforce itself across state lines. The creditor must give it local effect under the procedure of the state where the assets sit, and each of the three states below runs that procedure on its own terms.

New York supplies no outbound procedure. That is the first thing to grasp. The destination statute decides what gets filed, who receives notice, which date starts the response clock, and where objections belong. Most debtors first hear of domestication from a bank. I understand why the notice goes unread.

The Destination State Supplies the Procedure

The judgment has local effect once filed. It was never tried here.

Three states mean three clocks. Texas keys its process to the mailed notice. Florida separates the recording date from the clerk mailing date. California starts objection and freeze from service of the notice of entry. The foreign judgment is a sister state judgment traveling under full faith and credit. Counsel should fix each date from the docket.

No MCA specific fast track exists in any of the three acts. Creditors file where the assets sit.

First Action: Test the Texas Filing and Its Notice

In 1985, Texas placed its foreign judgment procedure inside a short chapter that still governs today. Under the Texas enforcement provisions for judgments of other states, the creditor files, if we are being precise, an authenticated copy with the clerk of any court of competent jurisdiction, and the clerk treats it as a judgment of that court, with the same effect and proceedings.

At filing, the creditor files an affidavit with last known addresses, mails notice to the debtor without delay, and files proof of mailing for the docket. If no notice arrived, give counsel the address history and the file. Rarely does the affidavit address match the mailbox the debtor checks today.

Stays cover pending or approaching appeals and any ground that would stay a Texas judgment, each with its required security.

Second Action: Separate Florida Recording From the Mailed Notice

Florida defines a foreign judgment as another state judgment entitled to full faith and credit. Under the Florida recording provisions for foreign judgments, a certified copy recorded with the circuit court clerk of any county takes the effect of a Florida judgment, with the same procedure and defenses.

The creditor records an affidavit with the debtor name, social security number where known, and last known address. Under the Florida notice provisions for recorded judgments, the clerk mails notice by registered mail with return receipt requested and dockets the mailing, with a creditor mailed cure where the clerk fails. The docket decides which mailing the deadlines follow.

Domestication works the way a translated deed works in a county recorder office. The words arrive from elsewhere, and the local office decides what they convey. Recording and mailing start different clocks. No execution or other process issues until thirty days after the clerk mailing, and no lien operates before then either.

Within thirty days after recording, the debtor may file an action contesting jurisdiction or validity and record a lis pendens toward the judgment. Under the Florida stay provisions for foreign judgments, the court must then stay enforcement and the lien, with a broader stay available on any Florida ground with like security. The creditor selects the county in order to reach the property, not to convenience the debtor.

Third Action: Calendar California From the Served Notice

California reaches the money part of another state judgment, support orders excluded, through an application under oath with an authenticated copy. Under the California application requirements for sister state judgments, the creditor addresses limitations, any sister state stay, the unpaid amount with interest figures and citation, prior proceedings, and the identity of the parties.

Filing belongs in superior court in a debtor residence county, or any county where no debtor resides. The clerk enters judgment for the unpaid amount with sister state interest and the filing fee. The creditor serves notice of entry in the manner of summons on a Judicial Council form.

Under the California vacatur provisions for entered judgments, the debtor may move to vacate within thirty days after service on any defense to a California action on the judgment, including incorrect interest math. No writ or other enforcement issues until thirty days after served notice, outside narrow exceptions. I have yet to see a thirty day clock wait for anyone to find counsel.

Fourth Action: Place Every Objection in the Receiving Court

Each state opens its own challenge: Texas the same proceedings available against its judgments, Florida the contest action with its lis pendens, California the vacatur motion with proof of service. Negotiation supplies none of those things. You signed the New York paper and now you answer in a court you never entered.

Resist the urge to answer the creditor while the clocks run. Any statement about the judgment, even briefly, travels into a file counsel has not yet read, and extremely few of those statements help. Simply forward every paper to the attorney responsible for the receiving state and confirm who handles the New York matter alongside.

Gather and keep the two court records together with proof of every mailing and service. What the creditor discloses, or withholds, about dates and amounts shapes the objection counsel must review and analyze before choosing the route. Independent counsel ensures the objection clocks are calendared while settlement talks proceed.

Local Effect Opens Another Set of Duties

Once the judgment holds local effect, exemption and collection questions belong to destination state law. A stay in one proceeding should reach counsel handling the other on the day it issues.

Delancey Street offers an initial discussion of MCA settlement possibilities through its business debt settlement service. The company is a settlement company, not a law firm, and its commercial role stands distinct from representation by independently licensed counsel. Delancey Street ensures the negotiation addresses each judgment and filing that requires resolution. Confirm scope and fees, and identify the attorney responsible for each court.

The judgment travels. The procedure stays home.

The owner needs a response tied to the court now acting on the judgment. Distance never made a record less consequential, and the docket in the new county proves it.
