8 Exemptions That Limit What a Personal Guarantee Reaches for a California Owner in Practice

A signed guarantee creates liability but not automatic access to assets, so a California owner should test the homestead, wage, retirement, and refund shields one by one with counsel before conceding any property.

A personal guarantee promises payment. It does not promise which assets will satisfy the promise. The guarantee creates contract liability against the individual, and everything after that question runs through judgment enforcement law, where California statutes and federal shields decide what a funder holding a signed guarantee can actually reach.

Owners read the guarantee as a map of exposure. The map is drawn later, county by county and asset by asset, and the eight protections below show where California and federal law draw lines the guarantee cannot cross by its own force.

The Homestead Exemption in California

California Code of Civil Procedure section 704.730 sets the homestead exemption at the greater of the countywide median sale price for a single family home in the prior calendar year, capped at six hundred thousand dollars, or a floor of three hundred thousand dollars, with annual inflation adjustment from 2022. The figure protects equity above liens in a principal residence, and only surplus beyond the exemption remains available to a judgment creditor holding a personal guarantee judgment.

Dollar figures of this kind move with amendments and index adjustments. Counsel should reverify the current amount before advising on any equity cushion, since a stale figure misstates the shield by the exact amount of the drift.

Judgment First, House Second

Before judgment the funder holds no house taking power at all. The guarantee is a contract claim until a court converts it into a judgment, and only judgment enforcement proceedings can test the homestead, measure surplus equity, and seek a sale through court process. Threats of seizure issued before that sequence are pressure rather than procedure.

The guarantee signs away no deed. It signs the owner into a lawsuit the funder must still win.

Rental property stands outside this protection entirely, a distinction owners with second houses absorb too late.

Community Property Questions Around a Spouse

IRS Publication 555 names the nine community property states, and California stands among them alongside Arizona, Nevada, New Mexico, Washington, Idaho, Louisiana, Texas, and Wisconsin. A spouse who signed the guarantee is directly liable on the contract in every state, and no property regime analysis changes that signature. Whether the earnings, accounts, or home interests of a spouse who did not sign answer for the debt turns on state management and control rules rather than on the guarantee itself (a question the federal publication does not resolve, since it addresses tax treatment rather than creditor reach).

That parenthetical carries the entire warning. Counsel analyzes the signature page before the property regime, and the regime before any conclusion about the family accounts.

Federal Floor Under Wage Execution

Federal law caps garnishment of weekly disposable earnings at the lesser of twenty five percent or the excess over thirty times the federal minimum wage, with exceptions for support orders, certain tax debts, and chapter 13 orders. The floor travels with the paycheck into every state, California included, and it binds the funder regardless of what the guarantee says about payment.

Guarantor wages are reached, if at all, only through personal judgment enforcement against the guarantor. No prejudgment garnishment power exists, and a collector suggestion to the contrary deserves the skepticism counsel brings to every unverified assertion of authority.

Retirement Plan Benefits at the Plan

Federal pension law commands that plan benefits not be assigned or alienated, an antialienation shield that stops a private creditor at the plan administrator door. The statute recognizes exceptions, including qualified domestic relations orders, assignments predating September 1974, and plan loans meeting stated conditions, and each exception has its own elements rather than a general hardship override.

Whether this protection extends with equal force outside the large employer plan context is less certain than the preceding paragraphs might suggest. The individual retirement account, unlike the employer plan, looks to state law for its shield outside bankruptcy, and the relevant California provisions were not among the sources reviewed for this article.

Retirement Funds in Bankruptcy

Inside bankruptcy the Code exempts retirement funds held in accounts that are exempt from taxation under the enumerated sections, covering 401, 403, 408, 408A, 414, 457, and 501(a) arrangements, with favorable determination presumptions and continuity rules for rollovers and direct transfers. Federal bankruptcy guidance describes reorganization and the stay in general terms, while the exemption itself lives in the statute counsel will open to the exact subsection.

Once benefits are distributed to an ordinary bank account, plan rules stop governing and bank account exemption and tracing rules take over. Commingled funds present the hardest version of that problem, and commingling doctrines vary by state in ways no single article resolves.

Refunds and Benefits Outside Agency Channels

Federal tax refund offset runs for agency debt, and a private funder holds no key to that channel. The funder cannot intercept a federal refund through offset no matter how the guarantee reads, a limit that surprises collectors who speak as if every government pipe connects to their claim.

What remedy, if any, reaches a refund once deposited is a separate question for counsel and the exemption analysis above. The deposit does not launder the source, though proving the source after commingling is work rather than assumption.

What Exemptions Leave Exposed

Exemptions do not defeat purchase money mortgages, property taxes, or mechanic liens in most applications, and they protect against general judgment creditors rather than against every claimant. Surplus home equity, second properties, and accounts holding nonexempt funds remain reachable through proper procedure, and the guarantee itself endures as liability even where no current asset answers it.

A guarantee that appears on a credit file deserves its own verification, since a filing on a business report differs from repayment reporting and personal and business reports should be examined separately, as bureau guidance on business reports explains. California owners can also direct complaints about commercial financing misconduct to the state regulator, whose advisory invites small business reports and whose disclosure rules require cost and payment figures on covered transactions.

Delancey Street offers a free confidential initial review for owners whose guarantees are being pursued. The company operates as a settlement company and coordinates legal defense with independent counsel, since it is not a law firm. The aim is to ensure each claimed exposure is tested against the exemption that fits it, and to ensure no asset is surrendered that the law would have sheltered. Protection in this field is never automatic. It is claimed, documented, and defended.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
