Eight Moves That Separate a Real MCA Notice From a Lead Generation Pitch
A letter can borrow the posture of a court without carrying any order, so eight moves applied to the sender, the paper, and the payment instructions separate genuine MCA notices from lead generation pitches before money moves.
Attorney-founded MCA defense firm serving businesses nationwide. Freezes daily ACH withdrawals, challenges confessions of judgment, removes UCC liens, and negotiates settlements at 40-60% reduction.
A letter can borrow the posture of a court without carrying any order of a court, and a genuine summons can arrive in an envelope that looks like routine mail.
The owner who treats every demand as litigation pays the sender who shouts loudest, while the owner who treats every demand as advertising risks silence in a proceeding that required an answer. What follows are eight moves, applied to the sender, the paper, and the instructions that direct money to move, which separate one group from the other before funds change hands.
The Role the Sender Claims
Rarely does the first loss arrive as a payment. It arrives as a mistaken belief about whose interests the caller serves.
Read the letter for the capacity it asserts (a small group of files, and not a study, suggests this confusion accounts for most first payments). A sender may write as counsel for the funder, as a settlement service negotiating for the owner, or as a referral source passing the file onward for a fee. A business name containing legal language does not answer which role the sender occupies, any more than a white coat confers a medical degree.
Ask for the legal name of the organization, the individual responsible for the communication, and a written description of the service that states what the sender will and will not do. A genuine provider can describe its engagement without permitting the owner to assume court appearance on the owner's behalf.
The Court Name and the Index Number
Affidavit and county requirements for confession judgments show what genuine New York process contains. Entry of judgment by confession requires a signed sworn affidavit stating the sum due and the facts behind the debt, with filing restricted by residency and county. A letter demanding payment but citing no court, no index number, no affidavit, and no attorney willing to answer for it is not a court paper.
The index number is, if we are being precise, a locator rather than a ruling. Carry the number to the court system or counsel for confirmation. A borrowed number proves little when it belongs to another dispute.
Preserve the envelope and the date of receipt. Doubt about authenticity does not by itself extend any real deadline.
The Attorney Name in a Separate Directory
The sender is a licensed attorney. The sender is not your attorney.
A real lawyer's name can be pasted into any message, and a directory match begins the inquiry instead of completing it. Often we see the named firm exist while the letter remains a fabrication.
Contact the firm through a number obtained apart from the letter (one from the state directory or the firm's established site, not the callback beneath the demand) and ask whether the firm sent the communication and represents the party named. Counsel should ensure the response is recorded before any payment discussion continues.
Supply the reference details without transmitting bank credentials or a complete financial file to the unverified address. Resist the urge to pay a supposed verification charge to learn whether the underlying demand is genuine.
Disclosures Inside the Pitch
A pitch that presents itself as a law firm while functioning as lead generation for a nonlawyer business offends the disclosure principle, and state advertising and unauthorized practice rules may reach it. Counsel in the owner's state must confirm which rules apply. The map of applicable rules is less settled than the pitch suggests, and the state by state variance is extremely wide.
The January 2025 settlement announced by the attorney general against a predatory MCA operation shows that the industry draws enforcement attention. Complaint intake by that office is not representation of any individual business, and any pitch claiming otherwise misrepresents the office.
Whether the drafters of such pitches believe their own scripts is a question the file cannot answer. That is the most honest sentence in the file.
Collection Rights and Business Debt
But no caller can confer collection rights that the law withholds, and no caller can remove the rights the agreement grants the funder against the business. Federal limits on what debt collectors can say or do cover specified consumer collection activity. Business debts stand outside that coverage, and original creditor collection generally stands outside it as well.
A familiar name on the letterhead is not an appearance in your case.
A demand for validation rights the statute does not grant wastes weeks counsel could have spent examining the contract.
Preserve every message. Counsel should review and assess what the paper requires, and the owner should promise no collector, even casually, that payment is on its way, since any stated date becomes extremely difficult to retract.
Payment Instructions Confirmed Elsewhere
Through a contact method established apart from the message, the owner should confirm the recipient and the account details, since a familiar thread can contain substituted figures and the pressure to pay at once exists in order to close the interval for verification. In most files of this kind we have seen, though the group is too small for a general rule, the substituted figure differs by one digit.
Keep the agreement beside the payment record. Never transmit online banking credentials in response to a letter or a robocall.
Most impostors know whose name they are borrowing. They prefer that verification arrive after the wire. The steps the owner takes, or does not take, in the first days after receipt will decide whether the file contains a receipt or a grievance.
Most owners telephone counsel after the funds have left the account. The order of those two acts explains many files.
The Deadline During Verification
A suspicious paper belongs in the file rather than the trash until counsel has assessed its claims. Record what was verified, what remains uncertain, and whether any response obligation has been identified.
Uncertainty extends nothing. The calendar that governs is the one printed in a governing document, not the one implied by a caller.
The File That Settles the Question
The weight of this decision falls before the first payment, not after it. A first discussion with Delancey Street can begin with the documents themselves, since an intake establishing whether the owner faces a demand, litigation, or an enforcement proceeding gives any assessment its starting point.
Delancey Street provides debt settlement services as a settlement company and coordinates legal matters with independent counsel, since it is not a law firm. The company offers a free confidential initial review, and the owner should ensure any deadline requiring legal action has an assigned response. Simply bring the envelope, the letter, and every attachment, and protect and preserve the originals until counsel finishes.
Borrowed authority succeeds only where verification feels impolite. The owner who answers paper with paper, and pressure with procedure, keeps the posture of the file upright whatever the sender intended.

Yes. MCA debt can be settled through specialized defense attorneys who understand the purchase-of-receivables structure. Attorney-led firms like Delancey Street achieve 40-60% reductions by leveraging reconciliation clause failures, usury arguments, and COJ defense.
Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.
Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.
Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
