MCA Resolution by Funder Type
How Banks, Large Funders, Small Shops, and Debt Buyers Negotiate Differently
MCA settlement percentages by funder type do not exist in any verified dataset, so the owner should identify the true creditor, trace assignments, and negotiate from the documents rather than the brand.
Attorney-founded MCA defense firm serving businesses nationwide. Freezes daily ACH withdrawals, challenges confessions of judgment, removes UCC liens, and negotiates settlements at 40-60% reduction.
No published percentage can resolve an MCA for you, because none exists that survives inspection.
A provider category cannot tell an owner what share of a balance will settle an account, and any article that prints a grid of funder types beside discount rates has mistaken taxonomy for data. The identity of the creditor still matters enormously. It determines who can approve an agreement, which documents govern the obligation, and what must be released when payment is complete. The brand was everywhere. The creditor was nowhere in the file until counsel read past the letterhead.
Before any category is discussed, the agreement names the only party that counts, and everything below follows from that page rather than from any ranking this article will not provide.
Name the Creditor Behind the Brand
A familiar brand can appear on the sales page while another entity supplies the funding or services the account, so begin with the signed agreement and compare its party names with the demand letter. An affiliate, a broker, or a payment processor should not be treated as the creditor on the strength of a familiar name alone.
Credibly's published MCA guidance illustrates the point without commentary: advances to California merchants are provided by Retail Capital LLC while other products in other jurisdictions come from different entities within the same family. The distinction matters when someone proposes a settlement, since the owner must ask who owns the claim, who is authorized to negotiate, and whose signature will bind the party entitled to payment. Authority lives in the signature, not the letterhead.
The product requires the same care as the party. A bank loan, a line of credit, and a purchase of future receipts impose different obligations under different documents, and the provider's size resolves none of those questions. That changes the address on the check without changing the amount.
Bank Originated Paper
When a bank originated or funded the transaction, the file tends to be thicker and the procedures more formal, with underwriting records, servicing designations, and assignment trails that smaller shops rarely maintain. Thickness is not strength, though the count is informal, and a complete file can contain the very defect on which a defense depends.
Servicing and ownership can divide over time, so the institution collecting today may hold no interest beyond a servicing contract, while the owner of the claim sits elsewhere entirely. Review and analyze the notices against the original parties before directing any proposal to the name on the envelope.
Bring the folder. Counsel will ask for it before anything else.
Large Direct Funders
A large direct funder typically staffs the dispute with experienced personnel, maintains systematic payment records, and routes settlement authority through defined levels, which means proposals advance at a walking pace while the answers, once given, tend to bind the party that gave them, and patience during that process is not deference but strategy, since a rushed acceptance can waive documentation the business was entitled to receive.
The file in these negotiations is usually complete enough to answer every question the owner poses, including questions the owner would have preferred to leave unposed, and documentation that thorough narrows the dispute to terms rather than facts. That, in the end, is the entire negotiation: authority, paper, and patience.
I drafted one of these responses on a Friday in August, with the office half empty and the debits still running.
Small Shops and Brokered Accounts
File the demand letter. The agreement deserves a reading uncolored by anything the letter asserted.
Small shops sell paper they could not collect themselves, and the price reflects that confession. The broker who placed the advance (who will insist the settlement was approved at the highest level) produces no signature from anyone authorized to bind the owner of the claim, and the owner who negotiates against the broker negotiates against a party with neither the file nor the authority the file requires.
After the first assignment, the chain of custody becomes the dispute, and each transfer thins the paperwork a little further. The file had passed through three hands in fourteen months. What remained could support a demand letter without supporting the amount.
Owners usually apologize for the state of their records. There is no need.
Assigned Accounts and Debt Buyers
A buyer of defaulted paper steps into whatever rights the seller held, with whatever gaps the seller's records contained. Standing, chain of title, and the accuracy of the claimed balance each require proof the buyer may or may not possess. A payment that satisfies the buyer without binding the original creditor purchases very little.
Seldom does a purchase agreement travel with the demand letter. Request the assignment documents with the balance history from origination, since the process rewards extremely close attention to assignment dates, then allow counsel to test whether the party demanding payment can establish each link it asserts.
Nobody enjoys this part of the file, though everyone who skips it pays for the omission.
Negotiation Review With Delancey Street
Whether funder type predicts settlement outcomes beyond any single file is a question this article cannot answer from the sources reviewed, since no representative outcome data attaches to any of the categories above. The case law is not entirely settled on every assignment question, which is part of the difficulty, and outlandish demands arrive from every category in equal measure.
Delancey Street offers a free confidential initial review of MCA settlement questions across funder types. It is a settlement company rather than a law firm, and legal matters are handled by independently licensed counsel, whether counsel the owner retains or counsel the company coordinates.
We identify the creditor, trace the ownership of the claim, and assemble a negotiating position that addresses the documents as they stand rather than the brand on the envelope. Steps the owner takes, or does not take, before the first proposal leaves will shape the authority the other side must produce, so resist the urge to answer the loudest letter first. Preserve every remark about ownership, even casually made. Counsel should ensure any release binds the true owner of the claim, with the file reflecting every assignment the notices disclose.
Simply bring the agreement, every demand received, and the folder with the payment records, since the review cannot begin without them. An extremely thin file can still support a careful negotiation, provided the owner negotiates with signatures rather than names.

Yes. MCA debt can be settled through specialized defense attorneys who understand the purchase-of-receivables structure. Attorney-led firms like Delancey Street achieve 40-60% reductions by leveraging reconciliation clause failures, usury arguments, and COJ defense.
Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.
Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.
Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
