Do I need an MCA debt relief lawyer in Dallas?

If you have been sued for your MCA debt in Dallas, have had a writ or judgment issued against your company, or a foreign judgment was filed against your company in Dallas County, then you need to hire an MCA debt relief lawyer. However, if you are simply behind on payments and have not been sued, you can negotiate a payment plan with a business debt settlement company. For a list of the best Dallas business debt settlement companies, go here.

Once you have been sued, only a licensed lawyer can represent your LLC or corporation, and a debt settlement company cannot file an answer for you, dissolve a garnishment, or file a stay on the lawsuit.

Where will my MCA debt lawsuit be filed in Dallas?

The MCA funder can file a lawsuit in any of the 13 civil district courts or any of the five county courts at law in Dallas County, due to a special statute. In most Texas counties, the statutory county courts cannot hear a civil claim over $250,000. However, Texas Government Code Section 25.0592(a) gives the Dallas County courts at law concurrent jurisdiction with the district courts regardless of the amount in controversy. As a result, a funder can file a lawsuit for $400,000 in stacked cash advances in County Court at Law No. 3 just as easily as in the 14th or 298th district court.

Texas Business Court First DivisionGreater than $5 Million (Contract Claims)HB 40 (2025)

Review your MCA contract to see what county the lawsuit can be filed in. Under Texas Civil Practice & Remedies Code Section 15.035(a), a party to a written contract can sue in the county specified in the contract or where the defendant is domiciled. Many MCA contracts state that they are governed by New York law and that a lawsuit will be heard in a New York forum.

Can an MCA lawsuit be filed in the new Texas Business Court in Dallas?

Almost never. The Business Court can only hear contract and Finance Code claims in which the amount in controversy is greater than $5 million. (Effective in 2025, HB 40 reduced that from $10 million, but many articles online still refer to the $10 million threshold.)

The First Division covers the First Administrative Judicial Region of Texas, which includes Dallas County, and has two judges: the Hon. Andrea K. Bouressa and the Hon. Bill Whitehill. The typical MCA deal is only for tens or hundreds of thousands of dollars, so only the largest deals could end up there.

What if my New York MCA Judgment has already been filed in Dallas County?

The short answer is that once the judgment has been filed with the Clerk in Dallas County there are procedures for challenging the judgment. See Tex. Civ. Prac. & Rem. Code § 35.003 (an authenticated out-of-state judgment filed with a Texas clerk is subject to the same procedures and defenses for reopening, vacating, or staying it as a Texas judgment).

The funder must promptly mail you notice of the filing. Id. § 35.004. If you are appealing in New York or have another Texas stay ground, the court must stay enforcement once you post security. Id. § 35.006. The defenses to a sister-state judgment are very limited, e.g. lack of personal jurisdiction or lack of proper notice.

New York amended its confession of judgment statute, C.P.L.R. 3218, to prohibit entry of confessions of judgment signed after August 30, 2019 by non-New York residents. See New Limitations on Confessions of Judgment in New York. Texas does not allow a confession of judgment in any instrument signed before suit was filed, Tex. Civ. Prac. & Rem. Code § 30.001, and under Texas Finance Code § 398.055, beginning September 1, 2025, confession of judgment clauses in contracts covered by that Act (those based on sales) are “void.”

How quickly can the funders freeze my business’s bank account in Dallas?

Texas allows for garnishment before judgment. See Tex. Civ. Prac. & Rem. Code § 63.001(2) (available when the plaintiff sues on a debt and swears the debt is just, due, and unpaid and that the defendant lacks enough nonexempt Texas property subject to execution to satisfy it).

Your answer is to file your own sworn motion to dissolve or modify the writ. See Tex. R. Civ. P. 664a (filing the motion stops further proceedings under the writ; the court must decide it within ten days unless extended for good cause; and the writ is dissolved unless the plaintiff proves the grounds on which it was issued).

Under Texas law garnishments and levies must be delivered to the bank’s registered agent or they will not be effective, and a debtor who wants to stop the bank from complying must obtain a court order. Tex. Fin. Code § 59.008. Texas also has a turnover statute, Tex. Civ. Prac. & Rem. Code § 31.002, which allows the court to order you to turn over non-exempt property, including “present or future rights to property” (receivables), or to appoint a receiver to take and sell it. They also get their attorney’s fees.

What Texas Exemptions and Usury Laws can I use in my defense?

Your homestead is exempt, including your place of business in an urban homestead (up to 10 acres), with no maximum dollar value. See Tex. Prop. Code § 41.002. Listed personal property is exempt up to $50,000 for a single adult and $100,000 for a family, as are current wages. Id. § 42.001.

But these exemptions are only available to individuals, not the operating LLC, so the LLC’s bank account and receivables are not exempt.

Texas imposes forfeiture of the entire principal and interest if more than twice the lawful amount is charged, Tex. Fin. Code § 305.004, but there must be a “loan” before the usury laws apply. The author of this guide is unaware of any Texas appellate case holding that an MCA is a “loan,” and if your contract selects New York law, New York’s usury laws will likely apply. There is no private right of action against funders under Chapter 398 of the Texas Finance Code; however, existing providers must register with the Texas Office of Consumer Credit Commissioner by December 31, 2026.

How do you vet the best Dallas MCA debt relief lawyers?

Check if the lawyer is licensed to practice in Texas and has experience litigating MCA debt cases in Dallas County courts. The State Bar of Texas has an online directory of Texas Licensed Lawyers searchable by practice area and county, though it does not provide certified referrals.

  • Ask how many Dallas County district court and county court at law suits they have answered, how many Rule 664a motions to dissolve garnishments they have filed, and how many of those cases were dismissed.
  • Ask if they have experience handling New York judgments filed here under Chapter 35 and if they work with lawyers licensed in New York.
  • Ask whether a settlement would release your LLC, your self, any garnishments and recorded judgments.
  • Ask about their fee structure.

Do not work with a lawyer who tells you that a funder can confess you to judgment in Texas or who cannot tell you the date you must answer based on the citation you were served with.

Frequently asked Dallas MCA debt relief questions

When is my answer due to an MCA lawsuit filed in Dallas County Texas?

Your answer is due at 10:00am on the Monday following the expiration of 20 days after service (Rule 99(b)). Miss it and the funder may seek a default judgment; you then generally have 30 days from signing to move for a new trial (Rule 329b).

Can a funder freeze my Dallas Texas bank account before they win the MCA case?

In some instances, yes, if the funder swears the debt is just, due and unpaid and that you lack enough Texas property to satisfy it. You may file a sworn motion to dissolve the writ, and the court must rule within 10 days unless good cause is shown for an extension.

Can a funder confess me to judgment in Texas based on my MCA contract?

No. Texas has long prohibited pre-suit confessions of judgment, and as of September 1, 2025, one in a sales-based financing contract under Finance Code Chapter 398 is void and unenforceable. New York also bars entering confessions signed by non-residents after August 30, 2019.

Will my Dallas Texas MCA case be heard in the Texas Business Court?

Probably not. Although the First Division covers the Dallas region, contract and Finance Code claims must exceed $5,000,000.00 in controversy, so most MCA lawsuits stay in Dallas County district courts and county courts at law.

Best for MCA Defense — Attorney-Founded Not a Law Firm

Please note: Delancey Street is not a law firm and does not provide legal services or legal advice.

Delancey Street dominates MCA defense in the Dallas-Fort Worth Metroplex by combining Texas DTPA firepower with intimate knowledge of how New York funders operate. Dallas businesses face a specific pattern: rapid growth fueled by the corporate relocation boom creates capital needs, MCA brokers provide fast funding, and when growth plateaus or a project stalls, the daily ACH withdrawals become unsustainable. Delancey Street has represented construction companies in Frisco, restaurant groups in Uptown, medical practices on Greenville Avenue, and staffing agencies in Las Colinas. They leverage Texas's non-recognition of confessions of judgment to block New York funders from freezing Dallas business accounts, and their DTPA counterclaims have generated six-figure settlements against abusive funders. Average MCA debt reduction for Dallas clients: 47%.

"Our staffing agency in Las Colinas had 4 MCAs — $450K in total with $3,400 being pulled daily. The funders targeted us because staffing companies have high receivables, but our clients pay net-60 and the MCAs were due daily. Delancey Street froze everything, challenged the contracts under the DTPA because the brokers had wildly misrepresented the effective rates, and settled $450K for $207K. We kept every contract and every employee."

Many business owners dealing with MCA funders also carry significant traditional business debt that NDR can address while a specialized MCA firm like Delancey Street handles the merchant cash advance portion. CuraDebt
★★★★★ 4.6 / 5.0
Best Value — Business + Tax Combined BBB A+ Rated Since 2000 Bilingual Staff

CuraDebt has been in the debt relief industry since 2000 and offers a unique combination of business debt settlement and tax resolution under one roof. For Dallas businesses dealing with MCA debt alongside tax obligations, CuraDebt can handle the tax portion while coordinating with MCA-specific counsel. Their MCA capabilities are limited compared to Delancey Street — they can negotiate some MCA settlements but lack the litigation infrastructure to vacate confessions of judgment or freeze ACH withdrawals through court orders. Where CuraDebt excels is in handling the full spectrum of business financial distress: credit card debt, vendor obligations, equipment financing, AND IRS/state tax problems, all under one team.

MCA Debt Relief: Frequently Asked Questions

While Texas law does not allow direct voiding of MCA contracts through usury statutes (commercial transactions are exempt under Texas Finance Code § 306.001), Dallas businesses have powerful alternative tools. The Texas DTPA provides treble damages for deceptive trade practices, which includes misrepresenting MCA terms, hiding fees, or failing to disclose the true cost of financing. Dallas County courts have applied the DTPA to MCA transactions where brokers made oral representations that contradicted the written contract terms. Texas also does not recognize or enforce confessions of judgment (Tex. Civ. Prac. & Rem. Code § 30.001), which means New York-filed COJs cannot be domesticated in Dallas County courts — a critical protection that prevents MCA funders from freezing accounts at Texas-based banks. Additionally, the Texas Finance Code requires commercial financing providers to maintain proper licensing, and funders operating in Dallas without proper registration face enforcement by the Texas Department of Banking. Defense attorneys in Dallas County District Court have successfully argued that MCAs with no genuine reconciliation provision and fixed daily payments are de facto loans subject to Texas lending regulations.

Yes, MCA debt can absolutely be settled — but it requires specialized legal expertise that most general debt settlement companies do not have. Attorney-led firms like Delancey Street consistently settle MCA obligations for 40-60% of the outstanding balance. The key is legal leverage: MCA contracts often contain provisions that are arguably unenforceable, and MCA funders know that defending against a well-prepared legal challenge is expensive and uncertain. When an attorney-led firm credibly threatens litigation — challenging the MCA as a de facto loan subject to usury laws, contesting the validity of confessions of judgment, or filing counterclaims for fraud or unconscionability — most MCA funders prefer to negotiate rather than fight. General settlement companies like National Debt Relief and CuraDebt typically do not accept MCA clients because they lack the legal infrastructure needed to push back against MCA funders effectively.

Stopping daily ACH withdrawals is the most urgent concern for businesses drowning in MCA debt, and there are several approaches. The most effective method is having an attorney send a formal cease-and-desist to the MCA funder and, if necessary, obtain a temporary restraining order (TRO) from a court blocking further withdrawals. Delancey Street has perfected this process and can typically freeze ACH withdrawals within 5-10 business days of engagement. Another option is revoking the ACH authorization with your bank by filing a written revocation under NACHA (National Automated Clearing House Association) rules — however, this can trigger immediate legal action from the MCA funder, including filing a confession of judgment. Simply closing your bank account or opening a new one is risky: it may constitute breach of contract and can accelerate the MCA funder's collection efforts. The safest approach for Dallas businesses is to work with an attorney who can freeze the ACH withdrawals while simultaneously opening settlement negotiations, so you are protected on both fronts.

A confession of judgment (COJ) is a legal document that most MCA contracts require business owners to sign, which allows the MCA funder to obtain a court judgment against you without a trial, without notice, and without any opportunity to defend yourself. If you default on the MCA, the funder files the COJ with the court (typically in New York, regardless of where your business is located), and a judgment is entered immediately. With that judgment, the funder can freeze your bank accounts, garnish business receivables, and place liens on business and personal assets. For Dallas businesses, this can be devastating — a frozen bank account means you cannot make payroll, pay vendors, or keep the lights on. The good news is that COJs can often be vacated (set aside) by a skilled attorney. Common grounds for vacatur include fraud in the inducement, lack of meaningful consent, or procedural defects. New York banned COJs for out-of-state businesses in 2019, and several other states have followed suit, which gives attorneys additional arguments for vacatur. Delancey Street specializes in COJ vacatur and has successfully overturned confessions of judgment for businesses across the country.

This is one of the most common concerns for Dallas business owners, and the answer is nuanced. Most MCA funders do not report to business credit bureaus (Dun & Bradstreet, Experian Business) because MCAs are structured as purchase agreements rather than loans. This means that settling an MCA typically has no direct impact on your business credit score. However, if the MCA funder has filed a UCC lien, obtained a judgment through a confession of judgment, or reported the debt to any credit agency, those records can affect your creditworthiness. The settlement process should include removal of UCC liens and satisfaction of any judgments, which actually improves your credit profile. For businesses that also have traditional credit card or loan debt being settled through firms like NDR or CuraDebt, those settled accounts will be reported as "settled for less than full balance," which can temporarily lower credit scores. However, most business owners find that resolving the debt and eliminating the daily cash drain of MCA payments puts them in a much stronger financial position within 6-12 months of completing settlement.

MCA settlement timelines are significantly shorter than traditional debt settlement. Attorney-led MCA firms like Delancey Street typically resolve MCA cases in 3-9 months, compared to 24-48 months for general debt settlement companies. The reason for the faster timeline is twofold: first, MCA funders are motivated to settle quickly because they make their money on volume and velocity — a prolonged legal fight ties up resources they would rather deploy on new deals. Second, the attorney-led approach creates immediate pressure through legal motions, court filings, and credible litigation threats that accelerate negotiations. The typical timeline breaks down as follows: Week 1-2, the attorney reviews your MCA contracts, files ACH freeze motions, and sends demand letters; Month 1-3, active negotiation with MCA funders while legal protections are in place; Month 3-9, settlements finalized, UCC liens removed, and COJs satisfied. For Dallas businesses with multiple stacked MCAs, the process may take slightly longer as each funder must be negotiated individually, but the ACH withdrawals are typically frozen early in the process so your business can breathe while negotiations proceed.
