The best San Diego business debt settlement companies understand there is no license to settle a company’s debt, put their fee in writing, know when the funder can send a court judgment to the Sheriff’s office to levy bank accounts, turn the file over to a California licensed lawyer if the funder files a lawsuit or obtains a judgment, and close the file with a signed release and lien termination.
If you are looking for the best San Diego business debt settlement companies to stop the daily ACH withdrawal your merchant cash advance funder is making from your operating account, you won’t find much on sites ranking consumer debt settlement companies. If your funder has already sued you, go to our page on the Best San Diego MCA Debt Relief Lawyers, and for the best business debt settlement companies in California, see the statewide guide.
Does a San Diego business debt settlement company need a California license?
To settle a company’s business debt, there is no license or registration in California. A company settling consumer non-mortgage debt for a consumer must register with the DFPI starting on February 15th, 2025 (see DFPI’s page on debt settlement registration), though attorneys who settle debt in the course of representing a client are not required to register. Also, the Fair Debt Settlement Practices Act only applies to personal, family, or household debt.
The California Financing Law does regulate those who make or broker commercial loans, and DFPI’s licensee search shows whether the entity you borrowed from has a California Finance Lenders License. It is unlawful under Business and Professions Code Section 6125 for anyone who is not an active licensee of the State Bar to practice law, and you can check a lawyer on the State Bar’s licensee search.
How much do the best San Diego business debt settlement companies charge?
The best San Diego business debt settlement companies will charge you between 15% and 25% of the enrolled debt, and programs can take between 12 and 36 months, according to Business Debt Adjusters. No California statute limits fees for business debt settlement, and the Federal law that prohibits collecting fees before a settlement is completed covers only consumer debt relief programs sold by telemarketing. Check whether the fee is a percentage of enrolled debt or saved debt.
The best companies will also review the fees your funder is charging you. Since January 1st, 2024, SB 666 (Civil Code Section 1799.300, et seq.) prohibits funders from charging you an ACH fee that is not for a dropped payment or charging you for a payoff statement, and you can seek between $500 and $2,500 in statutory damages.
Which California rules give a settlement company leverage over your funder?
The best companies will know how to use the Cost Disclosure Law, DFPI’s small business unfair practices rule, and the Rosenthal Act for personal guarantors. If you obtained $500,000 or less in commercial financing, including a merchant cash advance, your funder has to make standardized disclosures about its cost. Since January 1st, 2026, under Financial Code Section 22806, if your funder quotes a “rate” or pricing, it has to disclose an APR, and it can’t use the word “interest” or “rate” in a deceptive way. The law does not say a missing disclosure voids the contract, so be wary of companies who say it does.
Starting October 1, 2023, 10 CCR 1061 bars unfair, deceptive or abusive conduct by a commercial funding provider toward a business with up to $16 million in gross receipts operated from within California. You can file on DFPI’s complaint page, though it doesn’t handle contract disputes. For credit entered into, renewed, sold or assigned on or after July 1, 2025, natural persons (including, as of Jan. 1, 2026, guarantors) are also protected by the Rosenthal Act if the debt is $500,000 or less to the creditor. It is unknown if an MCA is considered credit, but it’s worth a shot.
What happens to a settlement program when a funder sues or levies in San Diego?
The settlement company can still work with you, but once a lawsuit is filed or a judgment is entered, it can’t file for you and you are on a deadline. Your zip code determines where the case is filed: under Local Rule 1.2.2(E), civil cases from East or South County, including collection cases, go to the Hall of Justice, 330 W. Broadway, downtown, and North County cases go to the Regional Center at 325 S. Melrose Drive, Vista, per the court’s filing guide. You have 30 days after service of the summons to respond.
Many MCA contracts pick New York law, and if the funder sues you there, it will need to file a “sister state judgment” here to collect, and you will have 30 days after service of the notice of entry of judgment to file a Motion to Vacate under CCP 1710.40. And under California Code of Civil Procedure 1132, a confession of judgment entered on or after January 1, 2023 may not be entered in any California Superior Court.
At the judgment stage, the San Diego Court’s collection guide explains that the funder needs a Writ of Execution and a Sheriff’s Levy against your bank account: “Once the Sheriff’s Department serves the levy, the bank account is frozen and the account holder is notified.” Only money in the account when the bank is served is subject to the levy (CCP 700.140), which matters if your firm is collecting a lump sum from you. The Court also describes a “till tap” or “keeper’s levy,” where a sheriff’s deputy sits in your business for 4 or 8 hours and takes the money that comes in, which matters most for restaurants in the Gaslamp or bars in Pacific Beach. Only natural persons can claim exemptions, so an LLC bank account has none. If they levied your personal account as a guarantor, you have 15 days (20 if mailed) after service of the notice of levy to claim an exemption, and as of July 1, 2026, the first $2,325 in a deposit account is automatically exempt under the Judicial Council’s EJ-156 schedule.
What do I need in a San Diego settlement agreement?
Make sure all of the documents you need are written into the settlement agreement before you pay:
- Dismissal of the pending case with prejudice;
- If there is a Judgment, an Acknowledgement of Satisfaction of Judgment on form EJ-100, which the funder must file within 14 days of full payment;
- Release of any Abstract of Judgment filed with the County Recorder’s Office so that you can sell or refinance property in that county;
- UCC-3 to release the Funder’s UCC-1, written in as the Funder’s duty, because once they bought your accounts, under 9-513 of the UCC, you can only demand a termination after the account debtor has paid; and
- Release of your personal guarantee.
If you are a contractor doing business at Naval Base San Diego or the Marine Corps at Camp Pendleton, be sure your debt settlement provider knows the Assignment of Claims Act.

Frequently Asked Questions
Should my San Diego business debt settlement company be registered with DFPI?
As of February 15, 2025 debt settlement companies must register with DFPI to settle consumer non-mortgage debt. A company that only settles business debt such as merchant cash advances may not be registered at all.
Can the Sheriff take cash from my San Diego business while I am in a debt settlement program?
If the funder has a judgment against your business, yes. According to the San Diego Superior Court, the deputy can perform a “till tap,” taking the cash and checks out of the register, or a “keeper’s levy,” staying at your business for 4 or 8 hours and taking the cash receipts. Your debt settlement company can’t stop this.
How much do San Diego business debt settlement companies charge?
According to Business Debt Adjusters, most charge between 15% and 25% of the enrolled debt, and programs last 12 to 36 months. There is no fee cap on business debt settlement in California and the Federal Ban on Advance Fees applies only to consumers.
Can my funder use a confession of judgment against my San Diego business?
Not in a California court if it was entered on or after January 1, 2023, under Code of Civil Procedure 1132. If the judgment was confessed in another state, the funder can still register it here, and once you are served with notice of entry you have 30 days to file a motion to vacate.

Please note: Delancey Street is not a law firm and does not provide legal services or legal advice.
Delancey Street brings its litigation-backed settlement model to San Diego's biotech, military, and hospitality-driven economy. Their attorneys leverage California's Commercial Financing Disclosure Law (SB 1235) to challenge MCA funders who fail to provide required APR disclosures — a common violation that strengthens settlement negotiations. For SD businesses dealing with out-of-state MCA lenders filing in New York, Delancey Street's bicoastal litigation capability is critical. Over $100 million settled with a 90%+ success rate.

Frequently Asked Questions
Business debt settlement is a negotiation process where a professional firm negotiates with creditors to reduce your total business debt. In San Diego, California's strong borrower protections — including SB 1235's commercial financing disclosure requirements and restrictions on enforcing out-of-state confessions of judgment — give settlement attorneys significant leverage. San Diego businesses also benefit from the distance between California courts and New York-based MCA funders, who face higher costs to pursue litigation on the West Coast. Settlement typically reduces debt by 40-60%.
Savings vary based on the type of debt, the creditor, and the settlement company you work with. On average, San Diego businesses save 30-60% of their enrolled debt before fees. Attorney-founded firms like Delancey Street tend to achieve higher reductions (40-60%) because they have litigation leverage that pure negotiation firms lack. After factoring in settlement fees (typically 15-25% of enrolled debt), most businesses still save 20-45% compared to paying the full balance. For example, a business with $200K in debt might settle for $80K-$120K plus $30K-$50K in fees, saving $30K-$90K total compared to paying everything in full.
Yes, but MCA settlement requires specialized expertise that most general debt settlement companies do not have. MCAs are technically structured as purchases of future receivables, not loans, which creates unique legal and negotiation dynamics. MCA funders are often aggressive — they use daily ACH withdrawals, confessions of judgment (COJs), and UCC liens to collect. Settling MCA debt effectively requires a firm that can freeze ACH withdrawals, challenge COJs in court, and negotiate from a position of legal strength. Delancey Street is the standout choice for MCA settlement for San Diego businesses because their attorney-led approach gives them the litigation capability needed to push back against MCA funders.
Business debt settlement can temporarily impact your credit, but the long-term effect depends on your situation. Settled accounts are typically reported as "settled for less than full balance" rather than "paid in full," which can lower your score in the short term. However, if you are already behind on payments or facing default, your credit is already being damaged — and settlement can actually help stabilize and eventually improve your credit by resolving delinquent accounts. Many San Diego business owners find that their credit scores recover within 12-24 months after completing a settlement program.
Most unsecured and certain secured business debts can be settled, including: business credit card debt, merchant cash advances (MCAs), unsecured business loans, lines of credit, SBA loan deficiencies, commercial lease obligations, vendor/supplier accounts payable, equipment financing deficiency balances, and business tax debt (with specialized firms like CuraDebt). Debts that are generally harder to settle include secured loans where the creditor has strong collateral, active SBA loans in good standing, and debts involved in active litigation (though attorney-led firms can handle these).
Timeline depends heavily on which firm you use and what type of debt you have. Attorney-led firms like Delancey Street can often settle business debt in 3-9 months because they use litigation leverage to accelerate negotiations. General settlement companies like National Debt Relief and CuraDebt typically take 24-48 months because they rely on accumulating funds in an escrow account before negotiating. The type of debt also matters — MCA settlements tend to move faster while bank loans and SBA debt can take longer due to institutional bureaucracy.
