Can a Business Debt Resolution Company Really Help? Lessons From Practice

A resolution company earns its fee in the file it constructs, not in the assurance offered during intake. Owners should test the assignment, the fee terms, and the limits of the engagement before changing payment arrangements.

A business debt resolution company earns its fee in the file it constructs.

Owners ask whether such a service can help with MCA pressure and stacked obligations. The answer turns on the assignment the business hands over, the condition of its records, and the willingness of each counterparty to accept terms the company can perform.

What the Service Performs

The assignment matters more than the advertisement. A defined engagement identifies each account in scope, names the person authorized to approve an offer, and states which tasks remain with the owner. Records arrive before proposals go out. Who does what appears in writing while the relationship is still cordial, which is the only point at which such clarity costs nothing.

We review the statements, identify the deficiencies, and construct a response that addresses both the contractual claims and the practical reality of the receipts available each week, because a proposal that ignores payroll, rent, and the obligations excluded from the program asks the creditor to accept arithmetic the business itself cannot defend for more than a fortnight.

A schedule covering eleven accounts across four funders exposes gaps no intake form captures. The provider was, if we are being precise, retained to organize the negotiation, and organization is where the value resides. Compulsion was never in the engagement. Missing amendments surface. Duplicate balances collapse into single claims. Stale addresses give way to current contacts with authority to decide.

A stale creditor address lingers in the file like a coat left in a conference room after mediation: present, unclaimed, and quietly expensive. The owner supplies statements and responds to requests. The provider maintains the calendar and records each contact. The file stays current when both sides perform these duties.

Fee Arithmetic and Cancellation Terms

Before funds move, the fee deserves examination equal to the debt. Request the base of the calculation, whether enrolled balances or measured savings, and the event that makes each charge payable. Ask about cancellation, refunds, and amounts described as earned upon enrollment. An extremely narrow definition of cancellation rights should prompt further questions before anything is signed.

The creditor was never a party to the service agreement.

Compare the service with the realistic alternative of direct negotiation, which demands records, hours, and attention the operating business may lack. A paid service earns its place where it performs defined work the owner cannot complete alone. Service charges vary more than intake conversations suggest, and the only reliable figure is the one stated in the engagement letter. The estimate was honest. It was also useless without the documents.

Resist the urge to measure value by the size of a projected reduction. The record the owner keeps, or neglects to keep, will decide more than any estimate offered before document review.

The Enforcement Backdrop

The FTC announcement of the 2022 MCA enforcement action describes charges against RAM Capital Funding and its owner Tzvi Reich concerning deceptive seizures from small businesses, followed by an order barring both from the MCA and debt collection industries. Legitimate negotiation and coercive extraction share a vocabulary of urgency. The order shows that pressure alone proves nothing about legitimacy.

Most aggressive collectors understand the line they approach. They prefer to leave it unexamined.

That history belongs in every intake conversation.

A provider with a record of complaints (who, it should be noted, may have operated under prior names that a cursory search will not connect to the current intake form) deserves examination before any payment changes hands. Comparison shopping remains difficult where disclosures are drafted in order to discourage it, which is why the engagement letter deserves a slower reading than the advertisement received.

Whether every aggressive collector invites the same scrutiny is a question the file leaves open.

Limits No Engagement Removes

Enrollment creates no stay against collection or suit. The U.S. Courts overview of Chapter 11 explains that a bankruptcy filing produces an automatic stay in most cases, subject to exceptions, while private negotiation supplies no equivalent protection. Claims asserted against the business proceed on their own calendar while the commercial discussion continues.

Without written confirmation from counsel, no assurance from a negotiator pauses a deadline. Forward new papers to counsel instead of assuming the provider holds copies.

A Review With Delancey Street

Delancey Street offers a free confidential initial review of MCA obligations. The company is a settlement company, not a law firm, and it coordinates legal matters through independently licensed counsel. Rarely does a counterparty explain why it refused an offer, and the absence of a reason is itself information about bargaining strength.

Simply bring the complete file to the first conversation, with the agreements, the withdrawal history, and a candid account of essential expenses. The timing runs to weeks in the files we have seen, though the sample is not scientific. Ask who performs each task, how offers receive approval, and what occurs when a counterparty refuses.

Ask the reviewer to ensure the engagement letter states fees, reporting, and the approval process for offers. Ensure counsel holds the litigation calendar where a case is pending. I have yet to see an intake estimate survive first contact with the bank statements, though estimates continue to be offered as if statements will not be read.

The creditor declined nothing in writing where no proposal was ever sent, and that silence should not be mistaken for patience. Resolution is a commercial conversation conducted under legal rules the owner did not draft. Consultation is where this conversation begins. The file the business builds now, with its peculiar arithmetic of receipts and obligations, will govern every option available later.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
