Can You Get a Business Debt Consolidation Loan With a Judgment Against You

A judgment against the business does not end consolidation options, but the lien position decides them: what the judgment attaches to, where it stands in priority, and whether new money can take a position that survives it.

A judgment against the business closes fewer doors than the owner fears and leaves fewer open than the broker admits. Consolidation remains available where the lien position allows it and disappears where the lien position forbids it.

The application reads as a question about creditworthiness. The underwriter treats it as a question about property. What the judgment attaches to, where that attachment stands among other claims, and whether new money can take a position that survives it decide the outcome before character or cash flow enter the discussion. Steps you take, or do not take, in the weeks after entry matter more than any explanation offered months later.

The Judgment Lien and the Consolidation Application

Months after entry, the judgment still reads as a live instruction to anyone who searches the record. Experian business reports include judgments alongside UCC filings and collections, and a consolidation lender reads all three before pricing anything. The report gives the court, the caption, and an amount the file treats as settled fact whatever the owner remembers about the underlying dispute.

A single page filed on a Tuesday morning can govern a refinancing discussed the following spring. The lender sees eleven digits of docket number where the owner sees old litigation. The docket number controls.

The lender prices the lien, not the explanation.

This is the point most applications miss. Owners arrive prepared to discuss revenue. The file demands the lien search first, since revenue cannot be pledged twice where a judgment already reaches it. Most owners do not call until the lien has already priced the loan. I understand why.

What Underwriters Read in the Public Record

The public record answers three questions in order: whether the judgment is entered, whether it is satisfied, and whether it attaches to the assets the new loan would need. The file is adequate for pricing to proceed once those answers are in hand.

Whether the report reflects the debt or the paperwork behind it is a question worth considering.

Judgments and UCC filings sit side by side in the report and mean different things. The filing perfects a bargained position in described collateral. The judgment announces that a court has fixed an obligation the creditor can enforce through remedies the agreement never granted. The share of applications carrying a judgment feels larger each year, though no bureau publishes the figure. Exceptions exist, though lenders treat them as curiosities rather than policies. The policies differ by lender more than the manuals admit. The report offers a peculiar comfort: completeness without explanation.

Lien Priority and the Collateral You Pledged

Priority decides the consolidation before underwriting begins. A new lender advancing funds to retire stacked advances needs a first position on something, or unsecured pricing that assumes the worst, and a judgment lien entered before the new security agreement stands ahead of it on every asset the lien reaches, with exceptions counsel must test. The collateral is reachable. It is also already spoken for.

Where the business pledged receivables and equipment under earlier MCA security agreements, the analysis compounds, because a security interest continues in collateral after disposition and reaches identifiable proceeds under the New York rule on proceeds, which means the new lender must map not only the judgment but every prior filing, every assignment of those filings, and every release that may or may not have been recorded when an old balance was retired.

The consolidation loan would, if we are being precise, sit behind the judgment on most of the assets that matter. Counsel for the borrower sometimes argues around this with subordination requests. That rarely matters at pricing.

Refinancing Through an SBA 7(a) Lender

The SBA 7(a) program permits refinancing of current business debt where eligibility is met. The guaranty runs to the participating lender under its terms. It leaves the borrower obligation where it found it.

Often we see owners arrive with an approval the program text never made. No federal guaranty converts a junior position on encumbered collateral into a senior one. We review and analyze the lien search and construct a proposal that addresses the creditor rather than the score.

What the Judgment Leaves for New Debt

Delancey Street offers a free confidential initial review for owners weighing consolidation against a judgment, and the review can test whether settlement of the underlying obligations would clear the path that new borrowing cannot. The company works as a settlement company and coordinates legal questions with independent counsel, since it is not a law firm. Counsel should ensure the lien search is complete before any application is signed, and the objective is to ensure no payment revives a stale claim without a written release. Resist the urge to move receivables in order to look unencumbered, even briefly, since diversion reads as a separate wrong rather than preparation. Simply bring the judgment, the lien search, and every security agreement to the first conference.

Old debt writes the terms on which new debt is offered. The owner who reads those terms before applying negotiates from the record rather than against it, and the record rewards preparation the way it punishes surprise: without comment.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
