Do I Have to Attend Any Hearings or Meetings? in Practice

Settlement talks do not excuse court attendance, so the owner should read the actual notice, confirm who must appear and through what procedure, and keep each professional in a defined role.

Attendance obligations survive every settlement conversation held about the same debt.

A representative can discuss payment terms on the telephone while a court expects the owner in a courtroom, and the business that confuses those separate processes can lose the opportunity to contest the claim. Before anyone assures you that everything is being handled, the relevant notice should sit on the desk, because the caption, the date, and the named party determine the next inquiry. A calendar invitation from a settlement company carries a different consequence from an order signed by a judge.

The Document That Summoned You

Read the paper that created the obligation before asking anyone whether attendance is required. An introductory consultation, a creditor negotiation, a deposition, and a court hearing are different events, although an anxious owner may describe all of them as a meeting about the debt. The document answers which of those events confronts the business, and no summary relayed by telephone can substitute for its text.

The distinction is extremely consequential where a business entity and an individual guarantor appear in the same dispute. Representation of the company does not establish representation of its owner, and the attorney should state in writing whose interests the engagement protects and whether personal attendance is required under the applicable rules. And the owner should keep that instruction with the notice itself, since the morning of the appearance is the worst moment to reconstruct who agreed to what.

In the cases we have seen, though the sample is not scientific, the attendance failure begins with a forwarded message rather than the underlying order. Obtain the complete notice with attachments, identify the tribunal and the docket, and confirm the location or connection details with the attorney responsible. The file should hold the original paper and the written explanation together, so that the person arranging travel or logging into the remote session can confirm what is required without a second round of calls.

Settlement Talks Do Not Move Court Dates

In its Chapter 11 guidance, the federal judiciary explains that bankruptcy proceeds as a court process and that filing generally creates an automatic stay, subject to exceptions. A private debt settlement engagement creates no such protection, and the difference governs everything about attendance while negotiations continue. The opposing party may seek an appearance in order to advance its claim against you even when a negotiator expects an offer within days.

A funder stating it will consider a proposal has not agreed to an adjournment. An adjournment, where available, must be obtained through the applicable procedure, and the request should be confirmed by the tribunal rather than inferred from a cordial exchange. Resist the urge to treat politeness on a call as permission to disregard a hearing date. The calendar controls until a document says otherwise.

Six months after the contract was signed, an owner can easily believe the dispute is nearly resolved while the docket shows an untouched scheduling order. Keep the event on the calendar until counsel confirms, with reference to a person and a paper, that the appearance is excused. A message stating that the account is under review leaves too much unresolved, and the question that matters is a narrow one.

Who confirmed that the appearance is excused, and in what document?

Nor can a general article determine whether counsel may attend without the client. Some proceedings require testimony, some require a party with settlement authority, and some accept the attorney alone. Those requirements vary by tribunal and by the nature of the event, which is why the question must be answered for the particular proceeding rather than imported from an earlier matter. A settlement conference invitation and an order directing an appearance are not interchangeable papers.

Who May Appear in Your Place

For a voluntary settlement call, ask whether the representative may conduct the discussion and report back in writing. For testimony or argument, counsel should review and analyze the notice and explain whether substitution is permitted. There are exceptions, though in practice they tend to confirm the rule. The answer turns on requirements no article can recite for every forum.

Simply name the participants early. The owner, another officer, the attorney, the settlement representative: each role should be assigned before the week of the event.

Preparation by Event Type

Preparation should reduce uncertainty rather than produce a recital of every frustration with the creditor. Assemble the notice and the documents it references, then clarify who can approve terms if the meeting produces an offer. These are extremely different assignments from testimony preparation, and neither benefits from the discovery that the wrong person holds the authority to speak.

  • Provide the complete notice, including every attachment.
  • Identify the business and any named guarantors.
  • Bring the agreement with the current payment history.
  • Disclose earlier offers and any promised appearances.

Any communication with the adverse party, even briefly, can alter the posture of the case, so substantive discussion should stay within the channel counsel recommends. A remote appearance still requires the same discipline: check the time zone, test the connection instructions, and keep a working telephone within reach. There is a particular quiet in a conference room at the end of a long mediation day, and the prepared file is what fills it.

Dividing the Work Between Counsel and the Settlement Company

Where a settlement provider and an attorney both participate, the owner should know which person confirms a court requirement. A commercial update may be useful without addressing attendance at all. Record the assignment in the engagement letter or a written instruction.

Prepare the internal authority the meeting requires. If a settlement discussion may produce an offer, determine who can approve the amount and whether another owner must be consulted. An available decision maker prevents a useful discussion from ending because the representative lacks authority to consider the proposed terms.

After the event, obtain a record of the next action from each professional. Counsel can identify any deadline or obligation arising from the proceeding, while the commercial adviser records any proposal requiring further review. A Delancey Street review can provide a starting point for examining settlement options for MCA balances while an attorney addresses the proceeding itself. Delancey Street is a debt settlement company, not a law firm, and legal matters proceed with independently licensed counsel. Confirm service availability and the scope of any engagement before relying on assistance with a particular account.

Attendance is often the visible part of a larger obligation. The negotiator manages the work accepted in the settlement engagement, counsel handles the legal work within the representation agreement, and the owner remains present in a process that can continue without agreement from anyone at the table.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
