How Do Merchant Cash Advance Fees Work? In Practice

MCA fees must be read as a set: net deposit, total collection figure, timing and frequency, adjustment and default charges, then relief compared from a common date.

A published factor rate advertises only a fraction of the true burden. The owner who wants the whole of it must follow three trails: the sum that landed, the sum exacted, and the calendar across which the exaction runs.

Low figures can mask a brutal collection rhythm. Only the agreement laid against the forecast reveals it.

Start With the Money Actually Deposited

Fix the spendable sum before doing any arithmetic. Face amounts flatter; origination bites, broker shares, and old balances intercepted in transit all shrink what operations can touch.

Simply demand an accounting of every deduction buried in the offer, from broker pay to processing tolls to balances swept from an earlier deal, since none of them count as money received.

Spendable cash is the only honest baseline.

An honest comparison hunts down every fee instead of saluting the largest. Summaries advertise; only the full offer does sums. No offer summary I have met volunteered its worst number.

The Total Collection Figure

The multiplier that builds the collection total is no annual rate, whatever its costume. A factor rate without a calendar resembles the menu posted outside a restaurant that closed in March: exact figures for a meal no longer served.

Pull the purchased total from the agreement and walk it line by line against the collection schedule. The disclosure packet ran to fourteen pages, most of them devoted to everything except the date the money had to be repaid. Any gap between promise and schedule calls for a written answer before signature. Our experience suggests the gap is common, though no survey supports the claim.

Chase each charge to its documented home in the signed agreement. An origination bite from proceeds, a sum piled onto the obligation, and a fee that sleeps until default all weigh differently. The owner should point to each on both the agreement and the cash sheet.

Old contract totals describe the wedding, not the marriage. Where the current demand outruns the remembered figure, call for a dated ledger of the account. The company deserves to know the claimed balance before it bargains over one, and arithmetic can prove what moved without settling whether the paper is a loan at law, a question for which counsel will want the clauses beside the columns. That dispute may yet end in a judgment against the business.

Time and Frequency of Collection

Time transforms a fixed toll. Daily drafts can empty the till before customers pay, though the month as a whole looked solvent on paper.

California commercial financing disclosure rules compel cost and payment data, annual rate included, for covered deals. Texas House Bill 700 compels its own schedule of disclosures for covered offers. Both regimes testify that funding alone cannot price a transaction.

Each regime stops at its own borders and thresholds. Disclosure duties do not double as universal answers on characterization. The disclosure satisfied the statute. It did not warn the borrower. How a third state would treat the same paper, I cannot say from the sources at hand.

Draw the collection calendar over the expense calendar. Mark the lean day draft, the contractual floor, and whatever reconciliation allows. The final cost is the money surrendered, the timing of its surrender, and the obligations left when the account is supposed to close.

Adjustment and Default Charges

In LG Funding v. United Senior Properties, a New York appellate court weighed reconciliation, term, and bankruptcy recourse when asking whether repayment stood absolute. The opinion anoints no universal rule that fee laden advances are loans in disguise.

Put reconciliation language and every default triggered extra before counsel for review. Return fees, collection cost clauses, and acceleration can redraw the claimed sum (and the creditor wielding them in order to press the business or its guarantor enforces ink dried months before the quarrel, commonly on the page the owner skimmed).

And the acceleration clause waits behind all of it. Do not mistake a disputed fee for a fee safely ignored. Keep the records whole and take advice on the reply. Concede nothing on a recorded line, even briefly, before counsel has heard it.

Counsel should ensure the owner can tell a demanded sum from an enforceable one. The two numbers answer to different masters.

Comparing Relief Against Continuing Collections

Anchor every option to one shared date. Current drafts, a lump payoff, and a settlement sketch each sweep different stretches unless pinned together, and the apparent bargain may consist of payments already gone. That is how comparisons lie without uttering a falsehood. Resist the urge to price an offer from its headline reduction. The owner should ensure any settlement sketch names its funding source before it is weighed.

Delancey Street extends a free confidential initial review to owners concerned about business debt. It works as a debt settlement company, coordinating legal questions with independent counsel, and it is not a law firm. Whether intake can help accounts already in litigation is a question the review, not a general article, answers from the actual file.

Sort sunk expense from negotiable charge before choosing among live options. Reconcile and record the decision with the balance used, the charges counted, and the figures still open, since the distinction is extremely clarifying once the ledger supplies it.

The cheapest exit can demand the dearest single check. Set any proposed sum onto the operating calendar, name its source, and count the steps taken, or not taken, before the next draft. Often we see the choice made from the summary alone. The wiser file holds the agreement, the dated history, and the arithmetic behind the decision.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
