Kabbage Debt Resolution
Trace the original Kabbage lender, current servicing authority, and product type before directing any settlement payment to a familiar brand name.
The only attorney-founded business debt settlement firm in our rankings. Litigation-backed negotiation, over $100 million in settled business debt, and a 90%+ success rate.
A borrower that directs payment to the Kabbage name on an old statement may pay the wrong recipient. Brands survive in files after the underlying business relationships have changed.
Resolution begins by establishing the original lender, the current servicer, and the party holding authority to compromise the account, a sequence that sounds methodical until the file reveals how many hands the balance has passed through.
The Name on the File
Payment sent to a familiar brand can satisfy no obligation at all. The recipient matters more than the amount.
The 2020 acquisition announcement placed the existing loan portfolio outside the transaction. A borrower should read that document before assuming every historic balance became an account of the acquiring company, beginning with the acquisition announcement excluding the existing portfolio.
In 2020, the brand changed hands while the portfolio stayed behind. The distinction governs every payment directed afterward.
Assemble the original agreement and the most recent notice side by side. A difference in names calls for an explanation rather than a guess about ownership, and the steps the borrower takes, or does not take, at this stage determine whether the later negotiation addresses the right counterparty.
Origination and Servicing History
The loan agreement names the lender. Everything else in the file is commentary on that page.
K Servicing describes a servicing function and directs borrowers to the loan agreement for lender identification, as its statement of its servicing role confirms. A servicing designation directs correspondence (though the records available to the borrower are sometimes incomplete, and the obligation to verify remains). Authority to discount the principal requires separate confirmation from the account records.
The servicer (which may have changed twice since origination, with each change generating notices that the borrower filed without reading, since the balance appeared unchanged) speaks for the account only within the authority to discount the principal that the current records confer.
Simply place each notice in chronological order. Gaps in the sequence deserve inquiry before an offer is sent. Counsel can review and analyze disputed authority or unclear documentation at this stage, and we ensure the eventual proposal names the account and the party authorized to resolve it.
Resist the urge to direct funds to a familiar address from an earlier statement. A collector paid by results has little incentive to correct confusion about who owns the account. Any change to payment instructions, even briefly communicated by telephone, deserves written confirmation through a channel the borrower already trusts, since a representative may press for payment in order to close the file before counsel has reviewed it.
It is extremely tempting to treat a familiar portal as evidence of current authority. Record the origination date and every assignment after it. Rarely does a file arrive complete, so the file should read as a chain rather than a pile.
Settlement Compared With Program Relief
An ordinary commercial settlement ends a private obligation by agreement. Program relief under the Paycheck Protection Program follows statutory conditions that have nothing to do with negotiation, which is an extremely expensive confusion to carry into a payment decision.
The two routes share a brand history in some files and nothing else. A borrower with both obligations needs separate entries, separate correspondence, and advice that addresses each obligation on its own terms, since conflating the two serves neither negotiation.
Whether every legacy account followed the same servicing path is a matter the individual file must answer.
Identify the product before selecting the route. The agreement date and the lender name on the original documents will identify it.
Building the Offer
Prepare a forecast of receipts and necessary expenses. The offer should fit expected capacity. The creditor evaluates feasibility before generosity.
A lump sum offer should identify the source of funds. An installment offer should show the payment dates against the forecast. A proposal that cannot survive its own forecast will not survive the creditor review.
Include other debts and essential costs in the same forecast. The proposal should not rely on cash committed elsewhere.
Keep the forecast dated.
Closing the Account
What does the proposed payment close? The answer should name the loan, the parties released, and the conditions of completion. An account number carries more precision than a reference to Kabbage debt. That is the standard the closing file should meet.
The release should arrive before the funds depart.
Federal guidance explains that canceled debt may create taxable income, subject to exceptions and exclusions, in the guidance on canceled debt and its exceptions. How long a compromise remains available is a question the creditor correspondence, not this article, must answer. A qualified tax review belongs in the assessment of the actual result.
Delancey Street offers a free confidential initial review of MCA debt concerns and advertises assistance with certain business debt situations. Ask the reviewer to identify the work it will undertake, the fee it will charge, and the process by which the borrower approves any creditor offer before funds move. The company is a debt settlement provider, not a law firm, and coordinates legal matters with independently licensed counsel, so a Kabbage borrower should confirm eligibility for the exact loan rather than assume enrollment is available.
Counsel for the borrower asked a single question at the closing call: who signs the release.
Most owners engage help after the second notice. The delay is understandable. Protect and preserve the release, payment evidence, and account confirmation as well, with enough care to pay the right counterparty once rather than the wrong one twice. An adviser should ensure the fee calculation and the handling of proposed payments are understood before performance begins.

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.
Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.
Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.
Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
