Attorney Backed or Attorney Owned Debt Relief
How to Establish Who Represents You

Do not infer representation from a label. Name the lawyer, obtain the signed engagement, match scope to the task, separate company fees from law firm fees, and confirm who holds funds before any deadline or transfer.

The name of the lawyer matters less than whether that lawyer has accepted responsibility for the matter.

A company can employ counsel, refer clients to counsel, or count an attorney among its owners without those facts answering who represents the customer, so the distinction should be resolved before the business relies on legal advice or assumes a court response is in preparation.

Marketing describes a service model, while representation requires an engagement, and the engagement letter is the hinge of the whole arrangement.

Whom the Attorney Represents

Begin with the direct question of whom the identified lawyer represents, whether the business, an individual guarantor, the settlement company, or another party, since those roles carry different duties that should never be assumed to align.

An attorney advising a company about its own operations should not be assumed to act for every person purchasing the services of the company, and where both a business and its owner need advice, counsel should address whom the engagement covers rather than treat the company position with the guarantor position as identical without examination.

Request the answer from the lawyer or law firm proposed as counsel, because a sales representative account of legal support cannot identify the client or the scope, and uploading documents to a company portal does not by itself create privilege.

The Work Behind the Label

An engagement to review a proposed settlement differs from representation in a lawsuit, and a negotiation assignment may exclude a court appearance, discovery or an appeal, so the owner should match the immediate task to the stated scope.

Where papers have been served, place the complete documents before the lawyer and ask who has accepted responsibility for the response, since a general consultation should never become the only basis for believing that a deadline is covered.

The New York pleading timing provision ties requirements and timing to the procedural posture, and a settlement company discussion of the account does not complete any required filing or service, a point that owners facing a short fuse often learn too late in the evening before the due date.

For an unfiled dispute, determine whether counsel will examine the agreement, advise on a guaranty or negotiate the resolution, with the scope stated in terms the client can recognize, and ask what follows where the matter changes, since a lawsuit may require a new assignment or an expansion of the existing one (a transition the original fee, which was quoted for negotiation alone during a forty minute intake call that never mentioned litigation, will not cover without adjustment).

The useful test is practical: where the funder files a motion tomorrow, whose task is it to decide what must be done, and the answer should require no further sales presentation.

Most owners ask about price before asking about scope, though the files reviewed here are too few to support a rule, and whether thrift at intake predicts regret at answer time is a question the record leaves open.

The label on the website describes the company, while the signature on the engagement letter describes the representation.

Ownership and the Engagement

Attorney ownership may explain the structure of a company, but it does not, if we are being precise, by itself establish the services purchased by any particular client, and the same holds for an outside counsel relation.

Read the agreement that names the service provider, and where a separate law firm engagement is contemplated, obtain it and learn when it takes effect, since uploading documents or paying an initial invoice does not complete that step by itself.

Privilege, permitted fee arrangements and admission in a particular court each require their own analysis, and the owner should infer none of them from a website label (a restraint advocates of either model will call excessive, since labels, in their telling, summarize what the paperwork confirms).

Fees and Funds Under the Actual Arrangement

The FTC debt relief guidance on the Telemarketing Sales Rule states that using attorneys does not exempt covered sellers from the advance fee restriction, and calling a charge a retainer does not change that result by itself.

That guidance should not be widened into a universal statement about every commercial engagement or attorney fee, since coverage with applicable state rules requires assessment on the facts.

The owner should request the calculation with the payment trigger for each service, determine whether a settlement company fee with a law firm fee both apply, and separate funds reserved for creditor payments from provider charges by asking who holds them, who can authorize a transfer and what records the owner receives.

The published account of a connection model for debt services illustrates why the receiving entity scope matters, since different parties may perform intake, negotiation and legal work, and the example proves nothing about any other provider.

Steps the owner takes, or does not take, before funds move will set the later arguments, in order to keep authority over money with the party the documents name, so resist the urge to approve transfers on verbal assurance, even briefly, since assurance evaporates while the record against the business accumulates in bank statements.

A Representation File That Holds

Often we see files where the engagement letter is missing and every other paper is present, and the missing paper is the one that decides the dispute.

We review the engagement, identify the gaps, and construct a file that addresses scope, fees and the practical reality of pending deadlines.

Simply insist that the hinge hold: a named lawyer, a signed letter, a stated scope.

Delancey Street presents itself as a debt relief company that coordinates with independent counsel rather than as a law firm, and an owner can ask which work the company will perform with which work independent counsel will handle. The objective is to ensure roles are written before reliance while counsel helps ensure no deadline is assumed to be covered, and the file that answers those questions is extremely spare in its contents and extremely plain in its terms.

Most buyers know what they purchased only after they need it, and they prefer not to examine the engagement until the motion arrives. I understand the impulse. Everything turns on that hinge, and the peculiar comfort of a complete file is that it asks nothing of memory. A quiet drawer holds the signed letter.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
