Default changes the forum rather than ending the options, and the firm that treats a defaulted file as a lost one has confused urgency with analysis.

The owner needs the papers read in order rather than reassurance, with counsel beside the commercial negotiation where judgments, levies, or proceedings demand a license the settlement company does not hold.

The Confession After Default

A confession of judgment in New York requires a signed sworn affidavit stating the debt and the terms that authorize judgment, with filing limited by residence and county (the affidavit states the debt and the terms that authorize judgment, a document the owner signed at funding and meets again in court). The statute governing confessions of judgment states the county rule counsel tests rather than assumes.

Confessions have funded uncontested judgments since before the current MCA market existed, which is why the affidavit formalities matter more than the balance. Funders file confessions in order to convert paper into judgment without argument, so counsel should read and test every affidavit line against the docket before discussing settlement.

You defaulted and then you discovered the confession. The calendar is extremely unforgiving at this stage, in the action against the guarantor as well as the company.

What Enforcement History Proves

In January 2022, after charges that included deceptive seizures from small businesses, federal enforcers barred MCA defendants from the industry. The federal account of the RAM Capital Funding enforcement action proves that predation draws prosecution, and the bar remains in force.

The order binds its defendants, and counsel reads it for conduct rather than comfort. What the order decides, or leaves undecided, about industry practice belongs to counsel rather than the brochure.

Judgments obtained against merchants that never appeared began as paper signed at funding.

Why Public Settlements Rarely Cover Your File

The January 2025 Yellowstone settlement followed a 2024 action concerning allegedly fraudulent loans disguised as advances, and monetary claims under it closed on January 9, 2026, with payments mailed to qualifying claimants in April 2026. The attorney general account of the Yellowstone settlement describes relief for covered obligations and named parties, not for every MCA, and litigation continues against some parties outside the settlement.

Your funder was not a party to that settlement.

A settlement that names another funder does nothing for your ledger. Whether similar complaints will produce similar funds is a question no honest reviewer answers in advance.

Counsel checks account inclusion and existing vacatur records before advising that any balance stands resolved, since the docket moves at its own pace and published summaries lag it. Public relief runs thin for files outside the caption, and the check for those inside it arrived at a glacial pace the docket explains better than the press release.

What Forgiveness Costs and Who Calls

Canceled debt can count as taxable income, with bankruptcy and insolvency exclusions subject to their requirements. The Internal Revenue Service discussion of canceled debt makes the discount a question the tax law answers separately from the negotiation, and the entity structure changes the answer.

Federal guidance excludes most business debts from consumer protections while leaving ordinary standards of honesty in place. The federal explainer on limits for debt collectors draws that boundary. Resist the urge to set the tax notice aside, even briefly, while the funder suit proceeds, since the tax question grows extremely sharp once a discount is signed.

The notice arrives on paper.

The Review a Defaulted File Deserves

Only after default does the full cost of the paper show itself. The file is extremely readable at this stage: every threat carries a date, and counsel reads the caption before the balance.

Delancey Street describes itself as a private business debt relief company based in New York and states that it is not a law firm, with legal work handled by independent counsel. A free confidential initial review for MCA distress is available from Delancey Street, and its published account of the settlement work gives the owner a place to begin, with proceedings traveling to independent counsel under a separate engagement. I am less certain about post judgment timelines than collectors pretend to be.

Simply bring the summons, the confession papers, and every statement since funding. The objective is to ensure no money moves before the paper is signed and to ensure counsel sees who will answer and defend the suit by name.

Consultation is where this review begins, and the review costs nothing while assuming nothing. The papers assembled at home outlast the pressure that produced them, and the reviewer that reads them first has earned the second meeting.
