The financing that arrives first often costs the most to carry. A bank loan and a merchant cash advance should be compared through their written obligations, their usable proceeds, and whether the January collections cover the February payroll.

Speed matters when a payment is due. The schedule that follows matters longer.

Compare Obligations Before Comparing Speed

Begin with the documents rather than the approval time. The MCA agreement states a remittance obligation tied to receipts or a fixed schedule, while the bank offer states principal, periodic payment, collateral, and guarantees in separate provisions. Compare and weigh the total obligation, not the periodic payment alone.

A product described as flexible should be tested against the month in which receipts fall rather than the month in which everything arrives as expected, which becomes extremely important when the forecast assumes the best recent month will repeat.

The broker presenting the faster option (who will describe bank underwriting as a formality that wastes the opportunity) is compensated for placement rather than for the accuracy of that comparison. Approval arrived within days. The ability to perform the schedule did not arrive with it.

Speed is the MCA industry's most honest feature and its most expensive one. I have yet to see a rushed comparison that favored the borrower, though our experience is limited to files where the choice had already gone wrong. What happens between the withdrawal and the receipt decides the comparison.

Eligibility Is Part of the Choice

A bank may require records, operating history, or collateral the business cannot produce at the moment. Identify those requirements before treating the option as available, and do not assume that a faster approval supplies equivalent terms. An approval that cannot be used on the date the money is needed is not an option for that date. Bank workout officers have a separate vocabulary for troubled credits, and owners usually learn it after the transfer rather than before.

The SBA 7(a) program description includes working capital and qualifying refinancing through participating lenders. The guaranty supports the lender's participation in the program; it does not remove the borrower's repayment obligation or establish that every MCA balance qualifies for refinancing.

Ask the lender which proposed use is eligible and what documentation supports it, and simply compare the documented offer rather than the advertised possibility. A productive purchase and the refinancing of an existing balance can require different showings.

Conditions and expiration dates belong beside the pricing in every comparison (a financing route cannot solve a time sensitive need if approval remains uncertain past the required date, and that limitation belongs in the decision alongside the rate).

Rarely does the cheapest advertised option remain the cheapest once eligibility, timing, and collateral are stated. Any direction from the lender by telephone, even briefly noted, should be confirmed in writing. Whether the bank would have approved the business a quarter later is a question no adviser can answer from the present file. That uncertainty belongs in the comparison.

Security and the Personal Promise

Either transaction may involve collateral or personal obligations depending on its terms.

A lender may seek a security interest in order to improve its recovery position. The business should understand what property the proposal covers and how existing claims against the receivables affect it.

Read and negotiate guarantee terms with counsel before signing, since a financing decision can carry extremely serious consequences where an owner accepts liability beyond the company's obligation.

Delancey Street offers a free confidential initial review when existing MCA debt is the reason for considering replacement funding, and an owner can ask whether the account qualifies for settlement assistance. The company acts as a settlement company and coordinates legal questions with independent counsel, since it is not a law firm.

The Legal Character Sits Beside the Price

In LG Funding v United Senior Properties, a New York appellate court treated reconciliation, a finite term, and bankruptcy recourse as relevant to whether an MCA imposed absolute repayment. The full appellate opinion on absolute repayment states a procedural result for the agreements before that court, not a nationwide rule for every advance.

Applicable law and the complete agreement matter, particularly where the owner considers raising loan characterization as a defense. A cost comparison can proceed alongside that legal review, since the two inquiries answer different questions.

Comparing a factor with an interest rate without stating the period resembles comparing the price of firewood with the price of coal by the bag while ignoring which fuel heats the house through January: the units match and the comparison misleads.

Whether courts in other states will weigh reconciliation as New York courts have is a question the present file cannot answer. Counsel should ensure the guarantee review precedes any signature.

Decide What the Business Can Complete

January exposes every financing decision made in a hopeful December. Test each option against the same operating forecast with essential expenses and a delayed receipt included, since a sanguine sales forecast flatters the faster option.

If a bank loan would retire an MCA, obtain the payoff and required releases before calculating savings. The amount needed to close the old account may differ from the balance the owner expects, particularly where fixed charges remain payable, and any claim against the business that survives the refinancing must appear in the new forecast. The owner accepts, or declines, each condition with the forecast in view.

The Delancey Street initial MCA review can assess negotiation as another route where existing advances drive the decision. Confirm eligible accounts, fees, and the source of settlement funds, and ask the adviser to ensure the comparison includes a negotiated resolution alongside any new financing offer. Most owners choose under the pressure of a due date. That pressure is real, and it explains more decisions than any brochure.

Availability is one fact in the decision, and the schedule the business can sustain is the more durable measure.

Resist the urge to let an immediate need obscure the obligations that follow funding. Some opportunities will not justify the financing offered to obtain them, and that conclusion, though difficult on the day the money is available, protects the business the forecast describes.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
