Do you want to find the best Jacksonville business debt settlement companies that follow all of the Florida business debt settlement laws, explain all of their fees, can work with a Florida Bar member to handle any Duval County Courthouse matters, and do not make false promises?
In an economy built around the Navy bases and JAXPORT, Jacksonville businesses often take an MCA to expand or survive, and sometimes it gets too expensive. Of the many debt relief companies advertising here, some work with Florida Bar members while others are just trying to get their fee. Does a debt settlement company need a license to work with a Jacksonville business?
Florida has no specific license for business debt settlement companies, but there are two potential issues. First, Florida prohibits budget planning. Section 559.10, Florida Statutes, defines budget planning as an arrangement where a debtor deposits a sum with a company on a periodic basis and the company distributes it among the debtor's creditors for a fee. Then Section 559.11 states that no person, firm, association, or corporation may engage in the business of budget planning. Section 559.12 has an exception for members of The Florida Bar practicing within the state. So, if your debt settlement company takes deposits from you and is not run by a member of The Florida Bar, it may be violating Section 559.11, a misdemeanor of the second degree under Section 559.13. The statutes only refer to a "debtor," and no Florida case applies them to MCA debt settlement; however, you may want to use a company that holds the savings in your own business's name to avoid the issue.
The second issue is Florida's Debt Management Services law. Section 817.804 requires these companies to have their funds audited by a CPA each year and to carry insurance of at least $100,000 or 10% of average monthly deposits, whichever is greater. These documents must be open for public inspection. It focuses on credit counseling and may not reach for-profit MCA debt settlement companies; however, any company that takes your deposits should have no issue providing similar documents to you.
How much will the Jacksonville business debt settlement company charge?
Most companies charge a percentage of either the enrolled debt or the savings. Although the FTC's Telemarketing Sales Rule prohibits debt relief companies from charging fees before they settle a consumer's debt, the Rule has an exception for businesses calling businesses under 16 C.F.R. § 310.6(b)(7). However, the FTC extended part of the Telemarketing Sales Rule to businesses in March 2024, and one of the extensions prohibits the debt settlement company from misrepresenting the potential savings, how long it will take, and the success rate of settling debt.
The law: setting up a debt management program in Florida cannot cost more than $50, and the monthly fees cannot exceed 15% of the monthly payment or $75, whichever is less, per Fla. Stat. § 817.802. What this means for you: if the MCA debt settlement company is not covered by this law, its fees are likely to be greater, but not illegal. Be wary if they quote an average MCA reduction without telling you what you will owe them, or require a fee before getting started. Most importantly, review their contract to see who is responsible for legal fees if the funder sues you while you are in their program.
How is the new Florida law of 2024 going to help the debt settlement company negotiate my MCA?
The law: any MCA entered into on or after January 1, 2024 must come with a written disclosure. If the provider consummated more than five commercial financing transactions with Florida businesses in a calendar year, it must give the borrower a written statement, per Fla. Stat. § 559.9613, that includes:
- Total funds provided to the borrower;
- Total amount required to be paid by the borrower to the provider;
- Total cost to the borrower in dollars;
- Method of collection of payments and the frequency of payments; and
- Any discounts for prepayment of the balance due.
Deals over $500,000 are exempt.
What this means for you: a good MCA debt settlement company asks for this disclosure in the initial consultation to compare against the payments you have made. However, per Fla. Stat. § 559.9615, only the Attorney General can enforce this, there is no private right of action, and a violation does not make the contract unenforceable. Also, the broker that brought you the advance is not able to charge you any fees in advance, per Fla. Stat. § 559.9614.
What if the funder sues me in Jacksonville?
They cannot file anything for you, but they can continue to negotiate. Make sure you know what law firm they use and whether its attorney is licensed in Florida. It is a third-degree felony to practice law in Florida without being licensed, or to hold oneself out as able to, per Fla. Stat. § 454.23.
Where will it be filed and what will be needed from the MCA debt provider:
| What is the claim? | Where will it be filed? | What do you need from the MCA debt provider? |
|---|---|---|
| $8,000 or less | Duval County Court, Small Claims Court | You can show up yourself or use an attorney |
| $8,000.01 to $50,000.00 | Duval County Court, County Civil Court (see the Duval Clerk county civil page) | An attorney in good standing with The Florida Bar to file an answer to the complaint by the date on the summons |
| Over $50,000 | 4th Judicial Circuit Court, Circuit Civil Court (the county court cap is $50,000 for cases filed after January 1, 2023, per Fla. Stat. § 34.01) | The same, from an attorney experienced in circuit court (see the 4th Judicial Circuit civil case management orders for cases filed after January 1, 2025, covering Clay, Nassau, and Duval Counties) |
| A New York judgment recorded with the Duval Clerk | County Civil Court, as a foreign judgment | An attorney ready to act within the 30-day window |
Even though many contracts say you agree to a "confession of judgment," Florida does not allow a pre-suit confession of judgment, per Fla. Stat. § 55.05. So they have to sue you, often in New York, and then record the judgment with the Duval Clerk. The judgment cannot be enforced against you for 30 days after the Clerk has mailed you notice, per Fla. Stat. § 55.505. To stop enforcement, you must file an action challenging the judgment and a lis pendens within 30 days of it being recorded with the Clerk, per Fla. Stat. § 55.509. If they get a writ after judgment and serve it on your bank, you, as an individual, have 20 days from notice of the freeze to claim an exemption, per Fla. Stat. § 77.041. Make sure the company can answer these questions!
How do you vet the best Jacksonville business debt settlement companies yourself?
There are three free links you should use to vet your business debt settlement company of choice. The BBB lists Jacksonville debt relief companies for consumer credit counseling and mortgage debt help, not MCA debt settlement negotiation.
- Search the company, its officers and any fictitious names on Sunbiz, the Division of Corporations database, which also shows judgment liens filed against the company.
- Ask who will represent you in court in Duval County and check that person in the Florida Bar member directory. It will tell you if they are eligible to practice and link you to any discipline the lawyer may have received.
- The Duval Clerk has a court docket search. Search the name of the debt settlement company to see if any prior clients or funders have filed actions against them, and check your own business name too.
If they will not give you the name of their lawyer in writing, or if they tell you to stop paying your funders without telling you what they will do if the funder files an action in Duval County, keep shopping.
FAQ on Jacksonville business debt settlement
Isn't it illegal for Jacksonville debt settlement companies to charge you before they settle your debt?
Generally, no. The federal law prohibiting debt settlement companies from collecting fees before settling your debt does not apply to calls made from business to business, so an enrollment fee up front is not illegal. The company still cannot misrepresent your savings, how quickly it can settle, or its success rate, and Florida's fee caps for debt management services may or may not apply to it.
Can't debt settlement companies represent me in court in Duval County?
No. Only a lawyer can file an answer, contest a New York judgment, or file an exemption for you in Duval County; unlicensed practice is a third-degree felony under Fla. Stat. 454.23. A reputable debt settlement company should work with a member of the Florida Bar whose name they can give you.
Which court in Jacksonville will the funder file in?
It depends on the amount. Small claims court hears cases of $8,000 or less, county civil court hears cases of $50,000 or less, and circuit civil court hears cases over $50,000. Foreign judgments, such as New York MCA judgments, are filed in county civil court.
Can't the funder just file a confession of judgment against my business in Jacksonville?
No. Florida law does not allow pre-suit confessions of judgment. Fla. Stat. 55.05 states that any pre-suit power of attorney to confess judgment is absolutely null and void. The funder has to sue you, most likely in New York, and then file the judgment with the Duval Clerk, which starts a 30-day window to contest it.

Frequently Asked Questions
Business debt settlement is a negotiation process where a professional firm negotiates with creditors to reduce the total amount your business owes. For Jacksonville businesses, Florida's legal framework provides certain protections — the state has a strong homestead exemption and its courts scrutinize out-of-state confession-of-judgment enforcement. A qualified settlement firm in the Jax market leverages these protections and understands Duval County commercial court procedures. Settlement typically reduces debt by 40-60% while you fund a protected escrow account.
Savings vary based on the type of debt, the creditor, and the settlement company you work with. On average, Jacksonville businesses save 30-60% of their enrolled debt before fees. Attorney-founded firms like Delancey Street tend to achieve higher reductions (40-60%) because they have litigation leverage that pure negotiation firms lack. After factoring in settlement fees (typically 15-25% of enrolled debt), most businesses still save 20-45% compared to paying the full balance. For example, a business with $200K in debt might settle for $80K-$120K plus $30K-$50K in fees, saving $30K-$90K total compared to paying everything in full.
Yes, but MCA settlement requires specialized expertise that most general debt settlement companies do not have. MCAs are technically structured as purchases of future receivables, not loans, which creates unique legal and negotiation dynamics. MCA funders are often aggressive — they use daily ACH withdrawals, confessions of judgment (COJs), and UCC liens to collect. Settling MCA debt effectively requires a firm that can freeze ACH withdrawals, challenge COJs in court, and negotiate from a position of legal strength. Delancey Street is the standout choice for MCA settlement for Jacksonville businesses because their attorney-led approach gives them the litigation capability needed to push back against MCA funders.
Business debt settlement can temporarily impact your credit, but the long-term effect depends on your situation. Settled accounts are typically reported as "settled for less than full balance" rather than "paid in full," which can lower your score in the short term. However, if you are already behind on payments or facing default, your credit is already being damaged — and settlement can actually help stabilize and eventually improve your credit by resolving delinquent accounts. Many Jacksonville business owners find that their credit scores recover within 12-24 months after completing a settlement program.
Most unsecured and certain secured business debts can be settled, including: business credit card debt, merchant cash advances (MCAs), unsecured business loans, lines of credit, SBA loan deficiencies, commercial lease obligations, vendor/supplier accounts payable, equipment financing deficiency balances, and business tax debt (with specialized firms like CuraDebt). Debts that are generally harder to settle include secured loans where the creditor has strong collateral, active SBA loans in good standing, and debts involved in active litigation (though attorney-led firms can handle these).
Timeline depends heavily on which firm you use and what type of debt you have. Attorney-led firms like Delancey Street can often settle business debt in 3-9 months because they use litigation leverage to accelerate negotiations. General settlement companies like National Debt Relief and CuraDebt typically take 24-48 months because they rely on accumulating funds in an escrow account before negotiating. The type of debt also matters — MCA settlements tend to move faster while bank loans and SBA debt can take longer due to institutional bureaucracy.
