Top 3 Michigan Business Debt
Settlement Companies

Michigan's manufacturing backbone — auto suppliers, tooling shops, and advanced mobility startups — faces a commercial debt reckoning as the EV transition disrupts established supply chains and capital requirements balloon. Detroit's revitalization has attracted aggressive commercial lenders targeting businesses expanding into newly viable neighborhoods. The state's Uniform Voidable Transactions Act and Michigan's relatively low statutory interest rate create leverage points that experienced settlement firms can exploit to reduce balances by 40-60%.

  7. Frequently Asked Questions

The best Michigan business debt settlement companies are licensed by the Michigan Department of Insurance and Financial Services under the Debt Management Act or work with a Michigan attorney, hold debtor funds in an insured trust account, have written fees, and have a plan if a funder sues in Michigan courts.

Unfortunately, most “best” lists skip Michigan’s debt management statute. Michigan’s Debt Management Act dates back to 1975, and it governs how debt management companies hold funds and charge fees, and proscribes certain actions. Whether your company is in Detroit or another state, use it to check that your contract is enforceable.

Do debt settlement companies need to be licensed in Michigan?

A company that creates a financial plan for you and takes your funds to pay creditors needs a license from the department, even if it is located outside Michigan. That is how Michigan defines “debt management” (MCL 451.412). Without a license, the debt management contract is null and void (MCL 451.414(1)).

The Act’s “person” includes corporations and LLCs, and it doesn’t distinguish business debts, so an LLC would appear to be a “debtor” under the Act. It is unclear how the department would apply the Act to firms that settle merchant cash advances, since some only negotiate and have you pay the funder directly. If a firm takes your funds to pay the funders, ask whether it is licensed and confirm it with the department.

The exemptions include an attorney whose advice to a debtor is incidental to the practice of law and a certified public accountant whose advice is incidental to the practice of accounting (MCL 451.413). So if a firm claims no license is needed because it works with an attorney, make sure that attorney is licensed in Michigan.

What fees can Michigan debt settlement companies charge?

Licensed debt management plans can charge only 15% of the debt that is being liquidated and a $50 setup fee (MCL 451.423). The debtor has until midnight on the third business day to cancel (MCL 451.428). Other contract terms include:

  • The contract is not effective until both parties have signed it and the debtor has paid any amount, and the three days run from then;
  • The company may bill for credit bureau reports and educational materials on top of the 15% fee, and may charge $25 if the debtor cancels later or defaults;
  • A licensee that overcharges must refund all undistributed payments plus a penalty equal to the overcharge; and
  • The licensee has 90 days to obtain consent from at least 51% of the debtor’s creditors, by number or dollar amount, to the plan. If it can’t, it must notify the debtor, who can close the account and get back all funds not yet paid to creditors.

It is unclear whether the department would apply the 15% cap to a percentage of savings merchant cash advance settlement fee, since the provision seems specific to debt management plans.

Federal law helps less than you might think. Although the FTC prohibits charging a fee before settling debt in its Telemarketing Sales Rule, most of the rule doesn’t apply to business to business sales (16 CFR 310.6(b)(7)), and the advance fee ban isn’t in the part that does. So yes, they can charge you up front, so make sure that you have it in the contract if they are promising not to!

Where is my money going to be held if I use a Michigan debt settlement company?

Licensees must use a trust account with a federally insured bank and deposit your money there within 2 business days of receiving it (MCL 451.425). They must reconcile it monthly and keep enough in it to cover every client at all times. If they use an out-of-state bank they must post a surety bond or letter of credit for at least 100% of average monthly deposits.

Ask your provider where your settlement reserve is held and to show it to you, because Section 425’s protections don’t apply to money kept in their normal account.

Are Michigan MCA funders required to disclose their costs?

Not as of this year. Venable LLP published a survey of state commercial financing disclosure laws in March 2026 and found that ten states have them: California, Connecticut, Florida, Georgia, Kansas, Missouri, New York, Texas, Utah, and Virginia. Michigan is not on the list. If your contract says one of these states’ laws governs, you may be able to use it, so have your provider check.

Without one, your provider should calculate the real cost based on the purchase price, the factor rate, and the debits. Michigan’s criminal usury law caps loans at 25% simple interest per year (MCL 438.41), but Michigan law prohibits corporations from raising the defense of usury (MCL 450.1275), and whether Michigan courts would treat a particular MCA as a loan at all is unsettled. So if your provider tells you your MCA is illegal in Michigan, they are probably getting ahead of the law.

Can a Michigan debt settlement company still help me if I’ve already been sued by my funder?

Yes, they can keep negotiating, but without a Michigan licensed lawyer they are not allowed to appear on your behalf in court, answer the lawsuit, or help you argue your exemptions, because that’s the practice of law in Michigan (MCL 600.916), and the Act separately bars a licensee from appearing as the debtor in court (MCL 451.429(d)).

Once you’re sued, time matters. You may only have 21 days to answer the lawsuit if personally served in Michigan, or 28 days if served by mail or in another state (MCR 2.108). Depending on the balance, you may be sued in district court (balances of $25,000 or less, MCL 600.8301) or in the business court docket of a circuit court (circuit courts with at least three judges, MCL 600.8033).

After a judgment they can try to garnish your bank account (you have 14 days to object after being served and your bank will hold the funds for 28 days, MCR 3.101), and if they get a judgment in New York, they can file it in Michigan with the court clerk and enforce it for ten years (MCL 691.1173). Frequently Asked Questions

Is a contract with an unlicensed Michigan business debt settlement company valid?

If the company is engaging in debt management (creating a financial plan for you and accepting money from you to pay your creditors), it must be licensed in Michigan, otherwise the contract is null and void. Attorneys and CPAs acting within their practice are exempt.

How much can a Michigan business debt settlement company charge for their fee?

The Debt Management Act allows a $50.00 set-up fee, a fee not to exceed 15% of the debt that they liquidate through their plan and an additional $25.00 if you cancel later or default. It is not known if this applies to merchant cash advance settlement fees.

Can I cancel my contract with a Michigan business debt settlement company?

Yes. You can cancel up until midnight of the third business day after the effective date of your contract by giving them written notice. Your contract becomes effective when you and the company have signed it and you have made a payment. The $25.00 fee mentioned above does not apply if you cancel this way.

Does Michigan have a commercial financing disclosure law for merchant cash advances?

As of March 2026, Michigan is not one of the 10 states that have a commercial financing disclosure law. So the funder doesn’t have to give you a disclosure and your settlement company will have to calculate the real cost based on the terms of your contract.

Can a Michigan business debt settlement company represent me in court?

No. Only a lawyer licensed in Michigan can practice law in Michigan. Under the Debt Management Act, a licensee cannot appear on behalf of the debtor in court. They can keep negotiating while a Michigan attorney handles the lawsuit.

Frequently Asked Questions

Business debt settlement is a negotiation process where a professional firm works with your creditors to reduce the total amount you owe. Instead of paying the full balance, you pay a lump sum or structured payment that is significantly less than what is owed — typically 40-60% less for the best firms. For Michigan businesses, the settlement company acts as an intermediary, leveraging their relationships with creditors and knowledge of industry practices to get the best possible deal. During the process, you typically stop paying creditors directly and instead make deposits into a dedicated escrow account. Once enough funds accumulate, the settlement company negotiates and pays creditors on your behalf.

Savings vary based on the type of debt, the creditor, and the settlement company you work with. On average, Michigan businesses save 30-60% of their enrolled debt before fees. Attorney-founded firms like Delancey Street tend to achieve higher reductions (40-60%) because they have litigation leverage that pure negotiation firms lack. After factoring in settlement fees (typically 15-25% of enrolled debt), most businesses still save 20-45% compared to paying the full balance. For example, a business with $200K in debt might settle for $80K-$120K plus $30K-$50K in fees, saving $30K-$90K total compared to paying everything in full.

Yes, but MCA settlement requires specialized expertise that most general debt settlement companies do not have. MCAs are technically structured as purchases of future receivables, not loans, which creates unique legal and negotiation dynamics. MCA funders are often aggressive — they use daily ACH withdrawals, confessions of judgment (COJs), and UCC liens to collect. Settling MCA debt effectively requires a firm that can freeze ACH withdrawals, challenge COJs in court, and negotiate from a position of legal strength. Delancey Street is the standout choice for MCA settlement for Michigan businesses because their attorney-led approach gives them the litigation capability needed to push back against MCA funders.

Business debt settlement can temporarily impact your credit, but the long-term effect depends on your situation. Settled accounts are typically reported as "settled for less than full balance" rather than "paid in full," which can lower your score in the short term. However, if you are already behind on payments or facing default, your credit is already being damaged — and settlement can actually help stabilize and eventually improve your credit by resolving delinquent accounts. Many Michigan business owners find that their credit scores recover within 12-24 months after completing a settlement program.

Most unsecured and certain secured business debts can be settled, including: business credit card debt, merchant cash advances (MCAs), unsecured business loans, lines of credit, SBA loan deficiencies, commercial lease obligations, vendor/supplier accounts payable, equipment financing deficiency balances, and business tax debt (with specialized firms like CuraDebt). Debts that are generally harder to settle include secured loans where the creditor has strong collateral, active SBA loans in good standing, and debts involved in active litigation (though attorney-led firms can handle these).

Timeline depends heavily on which firm you use and what type of debt you have. Attorney-led firms like Delancey Street can often settle business debt in 3-9 months because they use litigation leverage to accelerate negotiations. General settlement companies like National Debt Relief and CuraDebt typically take 24-48 months because they rely on accumulating funds in an escrow account before negotiating. The type of debt also matters — MCA settlements tend to move faster while bank loans and SBA debt can take longer due to institutional bureaucracy.
