The best business debt settlement Phoenix companies are either licensed under Arizona's debt management laws or don't take your money, have a contract stating their fees, are familiar with the local deadlines that start when a funder files a judgment in Maricopa County Superior Court, and will be straightforward with you when you should instead be talking to an Arizona lawyer.

It's up to you to make sure the company you choose conforms to Arizona law. If the funder already sued you, see the best Phoenix MCA debt relief lawyers, and for the state rules, the best Arizona business debt settlement companies.

Does a Phoenix debt settlement company need an Arizona license?

Business debt settlement Phoenix companies need to be licensed if they are going to take money from you and pay your creditors from those funds. A.R.S. 6-701 defines a debt management company as anyone who, for compensation, receives money from a resident of this state "as agent of a debtor for the purpose of distributing the same to his creditors," and its definition of a debtor doesn't exclude businesses. A.R.S. 6-703 requires a license from the deputy director.

Companies that don't take your money avoid the license. A.R.S. 6-702 exempts a bill paying service that doesn't negotiate with creditors and doesn't take possession of the debtor's money, as well as lawyers whose debt work is incidental to their practice. This is lawful, but the chapter's protections don't apply.

Under A.R.S. 6-707, a license issues only after the applicant posts an approved bond and the state reviews its financial responsibility and experience. Licenses expire on December 31 each year, and each office or branch needs its own.

What fees can a settlement company charge a Phoenix business?

If the company is not licensed because your savings stay in an account in your name, the fees are whatever you contract to pay. The federal ban on debt relief fees before a settlement is part of the consumer telemarketing rule, and 16 C.F.R. 310.6(b)(7) exempts calls made to sell goods or services to a business, except for the rule's ban on misrepresentations.

If the company is licensed, A.R.S. 6-709 limits it to a $39.00 retainer fee and then 3/4 of one percent per month of the total amount of your debt, but no more than $50 per month. It cannot charge a fee until it has notified all of your creditors, and your payments must go in a trustee checking account in an Arizona bank. A company that charges a percentage of your debt is unlikely to fit these limits, which is probably why most have you keep the money yourself.

Arizona doesn't have a state commercial financing disclosure law. This Venable article from March of 2026 lists the ten states that do, and Arizona is not among them, so a company claiming an Arizona disclosure law voids your advance is making a false statement.

The Arizona Consumer Fraud Act, A.R.S. 44-1521, says that "merchandise" includes services and that a person includes any corporation, company or other business entity. A.R.S. 44-1522 makes it an unlawful practice to use any deception, false promise or misrepresentation, or to conceal or omit a material fact, in connection with the sale of merchandise, whether or not anyone is actually misled. A.R.S. 44-1528 allows the state attorney general to seek restitution, disgorgement and a ban on the violator engaging in the trade or business.

What can a settlement company do after a funder sues you in Maricopa County?

A settlement company can always keep working on getting a deal, but unless it is a law firm with Arizona licensed lawyers it cannot file anything in court.

Many merchant cash advance contracts choose New York law. A confession of judgment signed at funding is not enforceable in Arizona because under A.R.S. 44-143 the power of attorney to confess judgment must be signed after the debt has come due. Most funders win or confess a judgment in another state and file it with the Clerk of the Superior Court of Maricopa County. Under A.R.S. 12-1702 the judgment is subject to the same defenses and stay procedures as an Arizona judgment:

  1. The funder mails you a notice of filing and a copy of the judgment under A.R.S. 12-1703.
  2. No garnishment or enforcement can issue for 20 days after mailing the notice of filing under A.R.S. 12-1704(C). A stay is possible by posting security.
  3. Unless the funder pays $25 for a search of other branches, a writ reaches only accounts at the branch where it is served under A.R.S. 12-1577. The bank sends you copies within 3 business days under A.R.S. 12-1574.
  4. You have 10 days after receiving the answer of the bank to file objections and request a hearing with the Clerk of the Superior Court under A.R.S. 12-1580. The hearing must be set within 5 business days of the request.
  5. Unless you object, the court enters judgment against the bank for the nonexempt funds, which the bank sends immediately under A.R.S. 12-1584.

Under A.R.S. 33-1126 an individual can exempt $5,000 in a personal account, indexed to inflation since 2024, but the exemption does not apply to LLC accounts. That is why you want a company that can close a deal before the 20th day or your objection deadline.

Which Phoenix court hears your case, and does it change who you hire?

The size of your debt will matter for which court your case will be in, and the larger the amount, the more you need good counsel.

Cases asking only for money less than $300,000 are not eligible for Commercial Court, so most funders will not be able to file there.

How do you compare the best Phoenix business debt settlement companies?

Ask any company you are considering the following questions in writing:

  • Who holds my money, and if you do, what is your Arizona license number and expiration date?
  • How much are your fees, when do you earn them, and if I want to fire you, how much do I have to pay?
  • If a funder mails me a notice of filing from Maricopa County, who calendars the 20 and 10 day periods, and who files anything needed, and are they licensed in Arizona?
  • Who signed each guaranty? Under A.R.S. 25-214(C)(2), both spouses must join in a guaranty for it to bind community property.
  • When you settle a judgment, will you file a satisfaction and release of the garnishment?

That last question protects you for years. A recorded judgment is a lien for 10 years on real property in the county under A.R.S. 33-964, and a judgment can be enforced for 10 years and renewed under A.R.S. 12-1551. So a "paid" deal that is never recorded in Maricopa County can come back to haunt you when you sell or refinance.

What red flags should Phoenix business owners watch for?

Some red flags are legal claims that are simply not supported by law. One is usury talk, when A.R.S. 44-1201 supports the agreement of the parties to any rate in writing. Another is the claim that a confession of judgment "can't be used in Arizona" with no qualification that an out of state judgment can still be filed in Maricopa County. A third is a list of supposedly "top Phoenix" programs that serve consumers with credit cards and do not take merchant cash advance debt. Always check the company's entity record with the Arizona Corporation Commission and make sure the name matches your contract.

Frequently Asked Questions

Can a Phoenix debt settlement company charge my business a fee before it settles anything?

Often. The federal advance fee ban for debt relief does not apply to sales to a business, and Arizona's fee cap only applies if the company is licensed and takes your money. Otherwise, the written contract sets when fees are paid.

How do I check whether a settlement company is licensed in Arizona?

Ask to see the company's Arizona debt management license and its expiration date. Licenses expire on December 31st and must be renewed each year, and each place of business needs its own license, posted in the licensee's office as the law requires.

Will a settlement company go to court for me in Maricopa County?

Not unless it is a law firm with Arizona attorneys. It can keep negotiating while the case is pending, but you or your attorney must file any request for a stay of proceedings, motion to vacate a judgment or objection to garnishment with the Clerk of the Superior Court in Maricopa County.

Is my confession of judgment enforceable in Phoenix?

An Arizona court cannot enter a judgment based on a document you signed at funding, because A.R.S. 44-143 requires the authority to be signed after the debt comes due. But a judgment confessed or entered in another state can be filed in Maricopa County as a foreign judgment.

Frequently Asked Questions

Business debt settlement is a negotiation process where a professional firm negotiates with your creditors to accept less than what's owed. For Phoenix businesses, Arizona's regulatory environment provides borrower protections — the state requires commercial financing disclosures and has consumer protection statutes that settlement attorneys can leverage against predatory MCA funders. Arizona courts generally do not enforce out-of-state confessions of judgment, giving Phoenix businesses a defensive advantage. Settlement typically involves redirecting payments into an escrow account while your firm negotiates 40-60% reductions.

Savings vary based on the type of debt, the creditor, and the settlement company you work with. On average, Phoenix businesses save 30-60% of their enrolled debt before fees. Attorney-founded firms like Delancey Street tend to achieve higher reductions (40-60%) because they have litigation leverage that pure negotiation firms lack. After factoring in settlement fees (typically 15-25% of enrolled debt), most businesses still save 20-45% compared to paying the full balance. For example, a business with $200K in debt might settle for $80K-$120K plus $30K-$50K in fees, saving $30K-$90K total compared to paying everything in full.

Yes, but MCA settlement requires specialized expertise that most general debt settlement companies do not have. MCAs are technically structured as purchases of future receivables, not loans, which creates unique legal and negotiation dynamics. MCA funders are often aggressive — they use daily ACH withdrawals, confessions of judgment (COJs), and UCC liens to collect. Settling MCA debt effectively requires a firm that can freeze ACH withdrawals, challenge COJs in court, and negotiate from a position of legal strength. Delancey Street is the standout choice for MCA settlement for Phoenix businesses because their attorney-led approach gives them the litigation capability needed to push back against MCA funders.

Business debt settlement can temporarily impact your credit, but the long-term effect depends on your situation. Settled accounts are typically reported as "settled for less than full balance" rather than "paid in full," which can lower your score in the short term. However, if you are already behind on payments or facing default, your credit is already being damaged — and settlement can actually help stabilize and eventually improve your credit by resolving delinquent accounts. Many Phoenix business owners find that their credit scores recover within 12-24 months after completing a settlement program.

Most unsecured and certain secured business debts can be settled, including: business credit card debt, merchant cash advances (MCAs), unsecured business loans, lines of credit, SBA loan deficiencies, commercial lease obligations, vendor/supplier accounts payable, equipment financing deficiency balances, and business tax debt (with specialized firms like CuraDebt). Debts that are generally harder to settle include secured loans where the creditor has strong collateral, active SBA loans in good standing, and debts involved in active litigation (though attorney-led firms can handle these).

Timeline depends heavily on which firm you use and what type of debt you have. Attorney-led firms like Delancey Street can often settle business debt in 3-9 months because they use litigation leverage to accelerate negotiations. General settlement companies like National Debt Relief and CuraDebt typically take 24-48 months because they rely on accumulating funds in an escrow account before negotiating. The type of debt also matters — MCA settlements tend to move faster while bank loans and SBA debt can take longer due to institutional bureaucracy.
