For a San Antonio lawsuit in Bexar County, you need an MCA lawyer who knows which court your funder selected and how long you have to answer there. The best San Antonio MCA debt relief lawyers also know how to stop a New York judgment from turning into a frozen business operating account.

When a funder sues you for a merchant cash advance in San Antonio, check the name of the court listed on the lawsuit. There are four different types of trial courts in San Antonio, and each has its own answer deadline. For MCA debt settlement companies, check our best San Antonio business debt settlement companies page. For the statewide picture, see our best Texas MCA debt relief lawyers page.

Which San Antonio Court Will My Funder Sue Me In For My MCA Debt?

The amount in controversy and the county named in your contract determine where your funder can sue you. Under a written contract, a funder can sue you in the county the contract names or where you reside, per Tex. Civ. Prac. & Rem. Code § 15.035. So, if you reside in Bexar County, your funder can sue you there.

The justice courts have civil jurisdiction up to $20,000, Tex. Gov't Code § 27.031, and Bexar's four justice courts sit on Pleasanton Road, Guilbeau Road, Interpark Boulevard, and East Loop 1604 in Converse. There are 15 county courts at law in Bexar County per chapter 25 of the Texas Government Code. Their civil jurisdiction runs to $250,000, see Tex. Gov't Code § 25.0003. Larger claims go to the 14 civil district courts at 100 Dolorosa: the 37th, 45th, 57th, 73rd, 131st, 150th, 166th, 224th, 225th, 285th, 288th, 407th, 408th, and 438th District Courts. The Texas Business Court's Fourth Division is in San Antonio, but after HB 40 it generally handles commercial disputes of $5,000,000 and up.

How Long Do I Have to Answer My MCA Lawsuit in Bexar County?

In justice court, you must answer by the end of the 14th day after you were served. If the 14th day falls on a weekend or holiday, you can answer on the next business day, see Tex. R. Civ. P. 502.5. In a county court at law or district court, you must answer by 10:00 AM on the Monday that follows 20 days after you were served, see Tex. R. Civ. P. 99.

The civil district courts in Bexar County generally set most hearings on a docket call before the Presiding Judge, who is one of the civil district court judges on a monthly rotation, see the Bexar Civil District Court Local Rules, updated July 1, 2026. The Presiding Judge sets the hearing before whichever civil district judge is available. The 225th and 285th opted out and have their own procedures. If you didn't answer and a default judgment was taken, file your motion to set it aside in the Presiding Court; if you answered, file it in the court that rendered the default.

What happens if the funder sued in New York or has a confession of judgment?

A confession of judgment in favor of a funder is virtually worthless against a Texas business. Texas long has prohibited confessing to judgment in a pre-litigation instrument. Tex. Civ. Prac. & Rem. Code § 30.001. In addition, effective September 1, 2025, a commercial sales-based financing contract that includes a confession of judgment (or any other similar provision) is void and unenforceable, Tex. Fin. Code § 398.055 (added by H.B. 700). New York no longer accepts confessions of judgment signed after August 30, 2019 by out-of-state debtors. N.Y. C.P.L.R. § 3218. Section 30.001 is limited, however, to pre-suit instruments, so read any agreed judgments or modifications with your lawyer carefully.

If the funder litigated the matter in New York, it can file the judgment in Bexar County under the Uniform Enforcement of Foreign Judgments Act, Tex. Civ. Prac. & Rem. Code ch. 35. Once filed, the judgment is enforceable as if entered in Texas, with the same defenses you would have to reopen, vacate or stay a Texas judgment. The creditor must mail notice to you of the filing, and the court can stay enforcement pending the outcome of an appeal if you post security.

Can an MCA funder freeze your San Antonio bank account or take your house?

The funder can freeze your business bank account but generally not your homestead. To get a writ of garnishment before obtaining a judgment, the funder must file an affidavit that the debt is “just, due, and unpaid” and that you do not have enough property subject to execution in Texas. Tex. Civ. Prac. & Rem. Code § 63.001. Once served, the bank must comply unless you obtain your own restraining order. Tex. Fin. Code § 59.008. Time is of the essence, therefore, once your business operating account has been frozen. If your personal account has been frozen, you must be given notice of your rights to protect property within three business days. Tex. R. Civ. P. 679b. As an individual, you can exempt:

  • Your urban homestead of up to ten acres, including land used for your business, with no limit on value. Tex. Prop. Code § 41.002. That covers a shop on the same parcel. The judgment lien does not attach to the homestead, and once you file a homestead affidavit the creditor has 30 days to contradict it. Tex. Prop. Code § 52.0012.
  • Personal property up to $100,000 for a family or $50,000 if you are single, plus your current wages. Tex. Prop. Code § 42.001.
  • Your 401(k) plans and IRAs, though distributions are only exempt for 60 days unless rolled over. Tex. Prop. Code § 42.0021.
  • Your non-signing spouse’s separate and sole management community property, which generally is exempt. Tex. Fam. Code § 3.202.

These exemptions are personal to you and do not apply to your LLC’s receivables, bank accounts or business equipment. Nor do they cover a duplex you rent out. However, a charging order is the exclusive remedy a judgment creditor has against your membership interest in the LLC. Tex. Bus. Orgs. Code § 101.112.

Can a San Antonio lawyer use usury or HB 700 against the funder?

Usury arguments can be raised but are subject to a factual analysis of the terms of the contract. Usury is severely punished in Texas with forfeiture of both principal and interest if the charge is more than twice what the law allows. Tex. Fin. Code § 305.004. For business loans over $250,000, the interest rate cannot be more than 28%. Tex. Fin. Code § 303.009. We are unaware of any Texas appellate court that has recharacterized an MCA contract as a loan, however, and most MCA contracts provide for New York law.

H.B. 700 is less likely to be the basis of a lawsuit but is a strong negotiating tool. Tex. Fin. Code ch. 398 does not create a private right of action, § 398.102, but it imposes a $10,000 civil penalty for each violation. It also bars providers from automatically debiting your account unless they have a perfected first priority security interest in the account and will require existing providers to register with the Office of Consumer Credit Commissioner by December 31, 2026.

How do you vet the best San Antonio MCA debt relief lawyers?

Start by confirming the lawyer is in the State Bar of Texas directory. You can search it by county and practice area, although the State Bar of Texas says that it is not a certified referral service. Then ask each lawyer the following questions:

  1. How many MCA cases have you defended? How many of those cases were in Bexar County as compared to New York?
  2. Have you set aside defaults in the Presiding Court? How do the 225th and the 285th differ?
  3. Have you opposed a chapter 35 filing of a New York judgment? What did the court require as security for a stay?
  4. Is your fee flat, by the hour or a percentage of what you save your client? What happens in a post-judgment turnover proceeding where the creditor can recover its attorney's fees pursuant to CPRC 31.002?

Frequently Asked San Antonio MCA Debt Relief Questions

How long do I have to answer a San Antonio MCA Lawsuit?

The end of the 14th day after service in a Bexar County Justice Court. In a Bexar County Court at Law or Civil District Court, your answer is due at 10:00 AM on the Monday following the twentieth day after service.

Can a Funder Collect on a New York Judgment in San Antonio?

A funder can file a New York judgment in Bexar County pursuant to the Uniform Enforcement of Foreign Judgments Act. Once the judgment is filed, it is treated like a Texas judgment. Defenses to the New York judgment can be raised and a stay of the judgment can be obtained pending an appeal or other challenge to the judgment.

Can a Funder Take My San Antonio Home if I Put up a Personal Guaranty?

A money judgment generally cannot be collected on a homestead. A homestead in Texas can be up to ten acres in an urban area. There is no limit on the dollar value of a homestead. The homestead exemption can include property used for business purposes. However, rental property and money in the bank are not exempt.

Best for MCA Defense — Attorney-Founded Not a Law Firm

Please note: Delancey Street is not a law firm and does not provide legal services or legal advice.

Delancey Street has developed deep expertise serving San Antonio businesses by understanding the city's unique MCA exposure profile. Tourism-dependent businesses along the Riverwalk experience dramatic seasonal revenue swings that MCA funders exploit — they advance capital during slow months, then extract crushing daily payments when tourist season returns. Delancey Street uses the Texas DTPA's treble damage provisions to create settlement leverage against funders who misrepresented terms to San Antonio businesses. They have represented restaurant groups on the Riverwalk, auto dealerships on Culebra Road, and medical practices in the South Texas Medical Center, achieving average settlement reductions of 44% for their Bexar County clients.

"Our Riverwalk restaurant group had 3 MCAs — $210K total — and the funders were pulling $1,600 per day even during our slow January-February period when tourism drops 40%. Delancey Street froze every ACH withdrawal, filed a DTPA complaint arguing the funders knew our revenue was seasonal but structured payments as if it were constant, and settled all three for $97K. That DTPA leverage is real."

Best Value — Business + Tax Combined BBB A+ Rated Since 2000 Bilingual Staff

CuraDebt has been in the debt relief industry since 2000 and offers a unique combination of business debt settlement and tax resolution under one roof. For San Antonio businesses dealing with MCA debt alongside tax obligations, CuraDebt can handle the tax portion while coordinating with MCA-specific counsel. Their MCA capabilities are limited compared to Delancey Street — they can negotiate some MCA settlements but lack the litigation infrastructure to vacate confessions of judgment or freeze ACH withdrawals through court orders. Where CuraDebt excels is in handling the full spectrum of business financial distress: credit card debt, vendor obligations, equipment financing, AND IRS/state tax problems, all under one team.

MCA Debt Relief: Frequently Asked Questions

San Antonio businesses benefit from the same Texas legal framework described above — the DTPA (Tex. Bus. & Com. Code § 17.46) with its treble damage provisions, the Texas Finance Code licensing requirements, and Texas's non-recognition of confessions of judgment. But San Antonio businesses have an additional angle: many businesses near Joint Base San Antonio serve military personnel or hold federal subcontracts, and the Servicemembers Civil Relief Act (SCRA) may provide protections for business owners who are active-duty military or reservists. Additionally, Bexar County courts have seen enough MCA disputes that local judges understand the predatory dynamics, and defense attorneys report that San Antonio courts are receptive to arguments challenging MCA contracts as unconscionable. The Texas Attorney General's consumer protection division has a regional office in San Antonio and has been increasingly active in investigating MCA-related complaints from local businesses.

Yes, MCA debt can absolutely be settled — but it requires specialized legal expertise that most general debt settlement companies do not have. Attorney-led firms like Delancey Street consistently settle MCA obligations for 40-60% of the outstanding balance. The key is legal leverage: MCA contracts often contain provisions that are arguably unenforceable, and MCA funders know that defending against a well-prepared legal challenge is expensive and uncertain. When an attorney-led firm credibly threatens litigation — challenging the MCA as a de facto loan subject to usury laws, contesting the validity of confessions of judgment, or filing counterclaims for fraud or unconscionability — most MCA funders prefer to negotiate rather than fight. General settlement companies like National Debt Relief and CuraDebt typically do not accept MCA clients because they lack the legal infrastructure needed to push back against MCA funders effectively.

Stopping daily ACH withdrawals is the most urgent concern for businesses drowning in MCA debt, and there are several approaches. The most effective method is having an attorney send a formal cease-and-desist to the MCA funder and, if necessary, obtain a temporary restraining order (TRO) from a court blocking further withdrawals. Delancey Street has perfected this process and can typically freeze ACH withdrawals within 5-10 business days of engagement. Another option is revoking the ACH authorization with your bank by filing a written revocation under NACHA (National Automated Clearing House Association) rules — however, this can trigger immediate legal action from the MCA funder, including filing a confession of judgment. Simply closing your bank account or opening a new one is risky: it may constitute breach of contract and can accelerate the MCA funder's collection efforts. The safest approach for San Antonio businesses is to work with an attorney who can freeze the ACH withdrawals while simultaneously opening settlement negotiations, so you are protected on both fronts.

A confession of judgment (COJ) is a legal document that most MCA contracts require business owners to sign, which allows the MCA funder to obtain a court judgment against you without a trial, without notice, and without any opportunity to defend yourself. If you default on the MCA, the funder files the COJ with the court (typically in New York, regardless of where your business is located), and a judgment is entered immediately. With that judgment, the funder can freeze your bank accounts, garnish business receivables, and place liens on business and personal assets. For San Antonio businesses, this can be devastating — a frozen bank account means you cannot make payroll, pay vendors, or keep the lights on. The good news is that COJs can often be vacated (set aside) by a skilled attorney. Common grounds for vacatur include fraud in the inducement, lack of meaningful consent, or procedural defects. New York banned COJs for out-of-state businesses in 2019, and several other states have followed suit, which gives attorneys additional arguments for vacatur. Delancey Street specializes in COJ vacatur and has successfully overturned confessions of judgment for businesses across the country.

This is one of the most common concerns for San Antonio business owners, and the answer is nuanced. Most MCA funders do not report to business credit bureaus (Dun & Bradstreet, Experian Business) because MCAs are structured as purchase agreements rather than loans. This means that settling an MCA typically has no direct impact on your business credit score. However, if the MCA funder has filed a UCC lien, obtained a judgment through a confession of judgment, or reported the debt to any credit agency, those records can affect your creditworthiness. The settlement process should include removal of UCC liens and satisfaction of any judgments, which actually improves your credit profile. For businesses that also have traditional credit card or loan debt being settled through firms like NDR or CuraDebt, those settled accounts will be reported as "settled for less than full balance," which can temporarily lower credit scores. However, most business owners find that resolving the debt and eliminating the daily cash drain of MCA payments puts them in a much stronger financial position within 6-12 months of completing settlement.

MCA settlement timelines are significantly shorter than traditional debt settlement. Attorney-led MCA firms like Delancey Street typically resolve MCA cases in 3-9 months, compared to 24-48 months for general debt settlement companies. The reason for the faster timeline is twofold: first, MCA funders are motivated to settle quickly because they make their money on volume and velocity — a prolonged legal fight ties up resources they would rather deploy on new deals. Second, the attorney-led approach creates immediate pressure through legal motions, court filings, and credible litigation threats that accelerate negotiations. The typical timeline breaks down as follows: Week 1-2, the attorney reviews your MCA contracts, files ACH freeze motions, and sends demand letters; Month 1-3, active negotiation with MCA funders while legal protections are in place; Month 3-9, settlements finalized, UCC liens removed, and COJs satisfied. For San Antonio businesses with multiple stacked MCAs, the process may take slightly longer as each funder must be negotiated individually, but the ACH withdrawals are typically frozen early in the process so your business can breathe while negotiations proceed.
