Top 3 Virginia Business Debt
Settlement Companies

Virginia's defense-contractor corridor, its data center boom in Northern Virginia, and the Hampton Roads maritime economy generate massive commercial lending volume targeting businesses dependent on government contracts and technology infrastructure buildouts. When procurement cycles shift or data center construction timelines extend, businesses carrying high-cost bridge financing face cascading debt crises. Virginia's Business Consumer Protection Act and its sophisticated commercial court system, particularly in Fairfax and Richmond, provide settlement advocates with well-established procedural pathways for challenging predatory terms.

The best Virginia business debt settlement companies will tell you if your merchant cash advance is covered under Virginia’s new law for sales-based financing which voids the confession of judgment clause and the clause that requires you to be sued in an out-of-state court. They will give you their fees in writing (Virginia does not license business debt settlement companies). And they will tell you if you should be using a lawyer instead.

Use this page to evaluate providers if your business is based in Virginia and you’re behind on your payments. As you’ll read below, Virginia regulates the funders, not the companies that help you negotiate with the funders.

Do business debt settlement companies have to be licensed in Virginia?

No, business debt settlement companies do not have to be licensed in Virginia to help businesses settle debt. Va. Code 6.2-2027 says, “No person shall engage in the business of providing or offering to provide debt settlement services to any consumer ... unless such person obtains from the Commission a license.” And Va. Code 6.2-2026 defines a consumer as an individual residing in Virginia who owes money for personal, family or household purposes.

Be careful of any company that says it is licensed in Virginia. Either it holds a consumer license, with a bond of $25,000 to $350,000 under Va. Code 6.2-2029, or it is misrepresenting its license. Virginia-licensed lawyers are exempt, so if you hire a law firm in Virginia to help you settle your business’s debt, make sure it is in good standing with the Virginia State Bar.

Can Virginia business debt settlement companies charge upfront fees?

Virginia business debt settlement companies can charge upfront fees to businesses. The federal ban on upfront fees protects consumers buying debt relief by phone, not businesses. The FTC’s Telemarketing Sales Rule exempts business to business telemarketing calls pursuant to 16 C.F.R. 310.6(b)(7), and those calls remain subject only to the rule’s prohibitions on misrepresentations and false statements. That regulation was amended in 2024.

Make sure you get all of your questions answered in writing in the enrollment agreement you sign with a business debt settlement company:

  • Is the fee flat, a percentage of the debt you’re enrolling or a percentage of the savings you get?
  • When do they get their fee, and is any of it prior to getting a signed settlement from the funders?
  • Where is the money you set aside for the fee held, and can you withdraw it if you cancel?
  • What happens to fees already paid if a funder sues and the company stops working your file?

Are Virginia merchant cash advances covered under the new sales-based financing law?

If your business has a primary place of business in Virginia, your merchant cash advances are likely covered if they are paid through a percentage of your revenue or through a fixed payment with a reconciliation clause and if they are for $500,000 or less in a single transaction. The new law, which is at Va. Code Chapter 22.1 of Title 6.2, was passed in 2022 as part of HB 1027 and broadly defines sales-based financing. Financial institutions are exempt, as are providers who do five or fewer such agreements with a recipient in a 12-month period, as are single transactions over $500,000. See Va. Code 6.2-2229.

The law depends on the location of the business, not where you live. If you live in Virginia but your business is in Maryland or the District of Columbia then you are not a “recipient” as defined in Va. Code 6.2-2228. The funder is entitled to rely on the address you gave on your application (Va. Code 6.2-2232(A)). So a provider should review your applications as well as your contracts.

A good provider should be obtaining

  1. A copy of the SCC required disclosure form. Va. Code 6.2-2231 requires the funder to disclose the financing amount, the amount disbursed after fees, the finance charge, the total repayment, the estimated number of payments, other fees, prepayment terms, collateral and broker compensation. They must do this on a separate form signed by you and the form must comply with Va. Admin. Code 10VAC5-240. They do not have to put the APR on this form but hopefully they know how to calculate it.
  2. Proof that the funder and broker are registered with the SCC. Providers and brokers have to register with the SCC and pay $1,000.00 (Va. Code 6.2-2230). There is an annual renewal of $500.00 which is due on September 15th of each year. Unpaid, the registration automatically expires. You can ask the SCC Bureau of Financial Institutions if they were registered on the date you signed your contract.
  3. Forum, arbitration and confession of judgment clauses.

A failure to register or disclose does not let you sue, as Va. Code 6.2-2238 gives enforcement to the Virginia Attorney General and there is no express private right of action. However any provision of the contract that violates the chapter is not enforceable against you (Va. Code 6.2-2236) and that may help you negotiate a settlement.

What can a settlement company do if the funder sues my Virginia business?

Once a lawsuit has been filed the settlement company can still talk to the funder, but it cannot answer the lawsuit, deal with motions or appear in court for you. Given Virginia’s quick time frames, ask your provider what they can do once you are sued.

Any suit on a contract covered by Va. Code 6.2 has to be filed in Virginia (Va. Code 6.2-2234). Any provision that says a suit has to be brought in another state is invalid. Arbitration cannot be done face to face unless it is in your home jurisdiction. The provider has to pay the arbitration fees. Confessions of judgment or any similar provision are not enforceable. So if your contract is covered by Va. Code 6.2 and the funder sues you in New York they may be starting from a weak position.

For contracts not covered, such as term loans, equipment financing, bank products and advances over $500,000.00, a confession of judgment can be entered in the clerk's office of any circuit court in Virginia (Va. Code 8.01-432). You have 21 days after notice of entry to file a motion to set the judgment aside or reduce it (Va. Code 8.01-433). The clerk has ten days to serve you with a copy of the judgment. If the judgment is not served on you within 60 days of entry it is void as to you (Va. Code 8.01-438). The funder can ask for a writ of execution to collect on the judgment 21 days after it has been entered (Va. Code 8.01-466). An out-of-state judgment can be docketed in any Virginia circuit court (Va. Code 8.01-465.2), subject to the same defenses as a Virginia judgment. To find a lawyer to help you defend a judgment go to our Virginia MCA Debt Relief Lawyers Page.

If only you signed a personal guaranty and you own your home as Tenants by the Entirety, your offer to the funder should reflect that they cannot impact your home even if they obtain a judgment against you.

How do you find the best Virginia business debt settlement companies?

Start by eliminating companies who mention Virginia usury laws. Virginia has a statute, Va. Code 6.2-317, which prevents parties from arguing usury with respect to business loans of $5,000.00 or more.

You should also eliminate any company that mentions their Virginia license as relevant to helping your business, doesn’t share their fee terms until after you’re enrolled, tells you to stop making payments to all of your funders, doesn’t ask to see your SCC disclosures, or doesn’t know whether or not Va. Code Chapter 22.1 applies to your deal and what will happen 21 days after a Confession of Judgment has been entered.

Frequently Asked Questions

Are the best Virginia business debt settlement companies licensed by the state?

Virginia does not license Business Debt Settlement Companies. Virginia does license Debt Settlement Companies under Va. Code 6.2-2027 but only for consumer services.

Can a merchant cash advance funder use a confession of judgment against my Virginia business?

If you have a Covered Sales Based Financing Contract (see Va. Code Chapter 22.1 for what that is), then Va. Code 6.2-2234(C) prohibits a Confession of Judgment clause from being enforced. Otherwise a funder can enter a Confession of Judgment and you will have 21 days after being notified of the judgment to file a motion to set it aside (see Va. Code 8.01-433).

Can I use Virginia usury laws to help settle my merchant cash advance?

Probably not, because Va. Code 6.2-317 bars usury arguments on business loans of $5,000.00 or more. Your leverage will come from the Sales Based Financing rules, your contract’s governing law and the limits on collection.

How do I find out if my funder registered with the Virginia State Corporation Commission?

Contact the Virginia SCC Bureau of Financial Institutions, since Va. Code 6.2-2230 requires funders and brokers of covered contracts to register.

Frequently Asked Questions

Business debt settlement is a negotiation process where a professional firm works with your creditors to reduce the total amount you owe. Instead of paying the full balance, you pay a lump sum or structured payment that is significantly less than what is owed — typically 40-60% less for the best firms. For Virginia businesses, the settlement company acts as an intermediary, leveraging their relationships with creditors and knowledge of industry practices to get the best possible deal. During the process, you typically stop paying creditors directly and instead make deposits into a dedicated escrow account. Once enough funds accumulate, the settlement company negotiates and pays creditors on your behalf.

Savings vary based on the type of debt, the creditor, and the settlement company you work with. On average, Virginia businesses save 30-60% of their enrolled debt before fees. Attorney-founded firms like Delancey Street tend to achieve higher reductions (40-60%) because they have litigation leverage that pure negotiation firms lack. After factoring in settlement fees (typically 15-25% of enrolled debt), most businesses still save 20-45% compared to paying the full balance. For example, a business with $200K in debt might settle for $80K-$120K plus $30K-$50K in fees, saving $30K-$90K total compared to paying everything in full.

Yes, but MCA settlement requires specialized expertise that most general debt settlement companies do not have. MCAs are technically structured as purchases of future receivables, not loans, which creates unique legal and negotiation dynamics. MCA funders are often aggressive — they use daily ACH withdrawals, confessions of judgment (COJs), and UCC liens to collect. Settling MCA debt effectively requires a firm that can freeze ACH withdrawals, challenge COJs in court, and negotiate from a position of legal strength. Delancey Street is the standout choice for MCA settlement for Virginia businesses because their attorney-led approach gives them the litigation capability needed to push back against MCA funders.

Business debt settlement can temporarily impact your credit, but the long-term effect depends on your situation. Settled accounts are typically reported as "settled for less than full balance" rather than "paid in full," which can lower your score in the short term. However, if you are already behind on payments or facing default, your credit is already being damaged — and settlement can actually help stabilize and eventually improve your credit by resolving delinquent accounts. Many Virginia business owners find that their credit scores recover within 12-24 months after completing a settlement program.

Most unsecured and certain secured business debts can be settled, including: business credit card debt, merchant cash advances (MCAs), unsecured business loans, lines of credit, SBA loan deficiencies, commercial lease obligations, vendor/supplier accounts payable, equipment financing deficiency balances, and business tax debt (with specialized firms like CuraDebt). Debts that are generally harder to settle include secured loans where the creditor has strong collateral, active SBA loans in good standing, and debts involved in active litigation (though attorney-led firms can handle these).

Timeline depends heavily on which firm you use and what type of debt you have. Attorney-led firms like Delancey Street can often settle business debt in 3-9 months because they use litigation leverage to accelerate negotiations. General settlement companies like National Debt Relief and CuraDebt typically take 24-48 months because they rely on accumulating funds in an escrow account before negotiating. The type of debt also matters — MCA settlements tend to move faster while bank loans and SBA debt can take longer due to institutional bureaucracy.
