To be charged with violating the eluding statute in New Jersey’s municipalities such as Bethlehem, Lambertville, Hampton or Holland; one must have knowingly fled in order to escape summoning by law enforcement officers despite being fully aware they were supposed to stop their vehicle at once.

Penalties for Eluding

A third-degree charge for eluding will leave one facing up-to five years behind bars and receiving fines amounting up-to $15,000. For second-degree charges, the penalty goes up to 5-10 years in prison, with fines mounting to as much as $150,000. It is worth noting that a presumption of imprisonment applies for second-degree eluding.
