Drug Distribution Charges in Burlington County: Crucial Information You Must Know
For you to be convicted of a drug distribution offense, prosecutors must prove that you acted knowingly or purposely, and it involves possession, manufacturing, or distribution of drugs or illicit substances.
The gravity of the charges determines the degree of the crime. For instance:
First Degree Crime РThis occurs when you are charged with trafficking in drugs, maintaining a CDS production facility, being a leader in narcotics trafficking networks causing drug-induced deaths, distributing 5 ounces or more of heroin, cocaine, MDMA (Ecstasy), or methamphetamine; 100 milligrams or more of LSD; or 25 pounds or more than marijuana. If found guilty, you could face up to 10-20 years imprisonment and at least $250,000 in fines.
Second Degree Crime – This applies when you distribute or sell at least one-half ounce of cocaine, methamphetamine, MDMA, or heroin; less than 100 milligrams of LSD; at least five pounds but less than 25 pounds of marijuana; or a minimum of 100 dosage units of prescription drugs such as Xanax, Suboxone, Methadone, and Oxycodone/Oxycontin. Second-degree charges also apply when the offense occurs within 500 feet of public parks or housing projects. If convicted, you face imprisonment ranging from five to ten years and up to $150,000 in fines.
Third Degree Crime – This charge applies to drug distribution cases where possession with intent to distribute is involved. It covers the sale of one half-ounce or lower amounts of ecstasy, methamphetamine, heroin, or cocaine; from an ounce but below five pounds for marijuana; and delivery of drugs within school zones. Third-degree charges carry jail terms of up to five years also accompanied by parole eligibility if your charges involve Brimage Guidelines or school zones.
Fourth Degree Crime – If your offense involves less than an ounce in weight for marijuana or fewer than four doses on prescription drugs consumption, then you could face fourth-degree crime charges.
