According to N.J.S.A. 2C:5-2 law,
“A person commits the offense of conspiracy when he or more agrees with another person(s) that they undertake or cause such conduct (distribute controlled substances).”
Under this law, every individual conspiring to distribute drugs or possessing drugs with intent to distribute can be prosecuted as if he/she actually committed a crime and will face prosecution and penalties as principal offenders.
Penalties for Conspiracy to Distribute Drugs/CDS in New Jersey
When it comes to conspiracy to distribute CDS, every individual conspiring or aiding and possessing drugs with intent to distribute can receive the same penalty as the person who completed or attempted to commit the transaction. However, penalties may change when someone conspires to sell or distribute more than the required amount of CDS necessary for a first-degree crime.
For instance, 5 ounces, or more, of cocaine, heroin, MDMA, or methamphetamine; 25 pounds or more of marijuana; and 100 milligrams or more of LSD all qualify as first-degree crimes.
The punishments for each degree of conspiracy charges include:
– Second-degree crime: 5-10 years imprisonment and a fine up to $150,000 ($200k fine for prescription legend drugs like Fentanyl, Suboxone Oxycodone/Oxycontin)
– Third-degree crime: three to five years imprisonment and a fine of up to $75k ($200k for prescription legend drugs and $25k for marijuana)
– Fourth-degree crime: up to 18 months imprisonment and a fine up to $10k ($25k for Schedule V Drugs)
