The NJ Eluding Law

Eluding refers to an offense governed by N.J.S.A. 2C:29-2b. This law could possibly result in a second-degree or third-degree crime charge in Camden County Superior Court. In some instances, depending on the situation, the offense may escalate into a second-degree crime where the defendant creates a risk of death or physical injury during flight or attempt to elude an officer.

Elements Necessary To Prove Eluding

Three main elements have got to be put in place for an individual charged with eluding before being proven guilty:
• The first element requires that he/she must operate any form of motor vehicle.
• The second states that such an incident happened on a “street or highway.”
• The third element suggests that after having received any signal from law enforcement agents, thus acknowledged personally by the fleeing driver after receiving any signal.

Once all these three elements are made out against someone charged with eluding, they will likely face penalties such as $15,000 in fines if convicted of third-degree eluding charges or even jail-term between 3-5 years.
Moreover, during either flight/attempted escape from an officer-directing traffic during this period, the driver violates traffic laws or even perceives a risk of injury to themselves or other road users. Such violations could even escalate the offense level up to second-degree Eluding, which involves fines of up to $150,000 fine, 5-10 years jail term, and suspension of driving privileges between 6 months-2years. Defendants are usually required to serve at least 85% of their prison sentence before being eligible for parole.
