New Jersey has implemented legislation that prohibits individuals from possessing or distributing any substance purported as an illegal drug. Specifically, N.J.S.A. 2C:35-11 makes it illegal to distribute or possess a material that isn’t a controlled dangerous substance (CDS). It doesn’t matter whether the accused genuinely believed that the substance was CDS; if they intended for it to look like one, prosecution could ensue.
The statute further explains aspects that signify criminal conduct under N.J.S.A. 2C:35-11:
• Selling packages resembling those used in illegal drug distribution.
• The actual or attempted distribution of fake drugs accompanied by money demands.
• Possessing or distributing substances looking like known forms of CDS.
Individuals found guilty of violating N.J.S.A. 2C:35-11 are committing felonies punishable by up to five years behind bars with fines reaching up to $200,000 instead of $35,000 typical in third-degree drug-related offenses. Additionally, as with any CDS conviction, the offenders will face compulsory six-month to two-year driver’s license suspension following an unsuccessful appeal.
