Assistance With Business Debt

Business debt help begins with sorting duties: calendar deadlines first, a cash forecast second, tax debts on a separate track, commercial settlement review apart from legal counsel.

Sound counsel on business debt comes from unexpected corners, not only obvious ones. A tax assessment, a contested advance, and a season of operating losses produce a single pressure from three unrelated causes, and each cause answers to a different discipline.

Progress starts when the work is divided among its proper owners. Someone must measure the cash, someone must answer paper that carries a date, and someone must say plainly what has been undertaken.

Begin With the Obligation That Controls the Calendar

Let counsel see any summons before negotiation spends down the days to answer. Let the forecast rule the morning when wages are in doubt. Most owners call after the money is gone. The delay is understandable.

The loudest account is, if we are being precise, a poor guide to urgency. A demand letter fourteen pages long decided the following month for one company that had planned to answer the telephone first.

Simply lay every obligation against the date it next demands action. Tax notices, secured loans, supplier balances, and any personal guaranty each belong beside the event that will force the next decision.

The calendar decides the order.

The owner should ensure the schedule cites the paper behind each line. Memory of an amount carries less weight than a present statement that shows the arithmetic.

The Cash Forecast

Survival lives in the forecast before it lives anywhere else. An accountant or bookkeeper can assemble the records and separate profit from cash available for payment, which is work that supports negotiation without pretending to settle any legal question.

The forecast should carry required operating expenses, expected collection dates, and the cost of materials for orders already accepted, because a payment that prevents the company from performing its own contracts exchanges one default for several, and the owner who approves such a payment has purchased quiet from one creditor with money owed to the next, which is a transaction the books will record even if the meeting did not.

Do not promote one remarkable month into the standing forecast for the year. Booked revenue can sit uncollected for weeks while obligations falling due stay invisible in the balance the owner carries in mind.

Six weeks after the first missed payment, the numbers look worse than the owner feared and better than the creditor claims. Both estimates deserve the same skepticism until the statements arrive.

There are exceptions, though in practice the exceptions tend to confirm the pattern. In most of the files we have reviewed, though the group is too small to support a general rule, the owner had overstated near term collections and understated the cost of staying open.

File every revision clipped to the paper that forced it. A changed number earns trust only when its reason stays attached.

Tax Debts Require a Separate Analysis

A private settlement with a lender does not settle the ledger with the revenue authority. Installment arrangements and qualifying offers in compromise exist under published requirements, and neither arrives because the balance has become inconvenient.

The IRS offer in compromise guidance conditions relief on filed returns, current deposits, and continuing compliance, while employers face separate deposit tests for current and prior quarters. A peculiar error occurs when the owner treats a commercial negotiation as progress against a tax lien sitting in the same file.

The IRS guidance on canceled debt treats forgiven balances as potentially taxable income, subject to exclusions such as insolvency. A negotiated reduction should pass before a tax professional before anyone describes the savings aloud. Resist the urge to celebrate a figure the revenue authority has not yet reviewed.

A reduction negotiated in December can become income assessed in April.

Retain the notices with their envelopes. The date of delivery can matter more than the date printed on the letter.

The Settlement Review

Delancey Street offers a free confidential initial review of business debt concerns. The company provides debt settlement services as a settlement company and coordinates legal matters with independent counsel, since it is not a law firm.

Confirm whether the specific accounts qualify, whether service is available, and what the engagement will cost. No settlement exists until the creditor agrees to one, and a negotiator can examine and test a proposal without securing its acceptance.

Ask for the fee schedule before the work begins.

Legal Questions Belong With Counsel

Federal court guidance describes Chapter 11 as a reorganization process with an automatic stay that follows filing, subject to exceptions. A consultation has value when private talks cannot bind every creditor to one set of rules, since a remark to the lending party, even casually, can narrow options counsel hoped to preserve. A collection suit against the business will not wait for the negotiation to conclude. Whether courts in every venue treat these timelines identically is a question I cannot answer from this desk.

The agreement was binding. It was also impossible to perform. Counsel should ensure the owner understands the difference between an amount demanded and an amount a court would enforce, because the agreement permitted this, and the owner signed it before the meaning was plain.

One creditor may press collection in order to improve its recovery while another accepts installments. A negotiator who promises that each creditor will accept identical terms is selling weather. Do not mistake the consultation for a decision to file. Its value can lie in charting exits while cash remains to fund one, through steps the owner takes, or does not take, in the first 72 hours after the notice arrives.

Rarely does a business fail for lack of advisers; it fails while the inventory, the forecast, and the engagement letter sit on separate desks. Work that deserves the name returns the company its own affairs in better order than they arrived, and the owner can then decide with the obligation, the cash, and the responsible professional all visible on one page. Keep that file intact after the engagement ends, for it is extremely difficult to correct a later misunderstanding from memory, and extremely easy to decide well from papers that tell the truth.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
