What Tariffs Mean for Merchant Cash Advance Borrowers in Practice

A margin problem receives no automatic adjustment under most MCA agreements, because higher landed costs can leave less cash for fixed withdrawals without reducing the receipts behind them.

A margin problem receives no automatic adjustment under most MCA agreements. Higher landed costs can leave less cash for fixed withdrawals without reducing the receipts on which those withdrawals are calculated, which is why a tariff question becomes a financing question faster than owners expect.

An importing business should join actual shipment costs to its financing schedule. The relevant figures come from its goods, entries, and contracts rather than from a general percentage applied to every industry.

The Cost of the Actual Shipment

Start with the shipment, not the headline. The CBP importer guidance on entry responsibility and duties explains that the importer of record remains responsible for entry accuracy and applicable duties, taxes, and fees even where a customs broker is used. Identify and document the merchandise, origin, and classification for the specific goods, with the costs the owner documents, or estimates, before the next order kept visible beside the figures the forecast assumed.

Seldom does a headline rate describe the importer's actual cost. The port collects what the entry states, and penalties attach to what it omits, a discipline older than any current schedule (the treatment behind that figure is shipment specific). The headline called the increase temporary. Most owners first meet the problem at the register, not in the papers. The surprise is understandable.

Simply compare the documented landed cost with the figure the forecast assumed. I have yet to see a forecast survive contact with an actual landed cost statement.

Keep the calculation with the entry papers.

Revenue Held Against Cash Retained

Sales and cash part company when input costs rise. A business can hold its revenue while retaining less from each transaction, and the receipts collected from customers may no longer support the same combination of operating expenses and financing payments.

An MCA tied to receipts behaves differently from an obligation tied to profit, and the actual contract decides the analysis. A thinner margin should never be assumed to trigger an adjustment right simply because pressure has increased, and amounts described as estimated in the agreement deserve a reading that tests what happens when the estimate fails. Revenue held steady. Cash available for debt fell. That is the mismatch the forecast must show, though demand may answer differently.

Have the adviser test the contract beside the updated cost forecast, identifying which adjustments concern revenue, which records they require, and which conditions govern a request. Counsel should ensure the reading reflects the actual terms and ensure communications claim no adjustment right the contract does not grant. Suppliers pass costs along in order to protect their own margins, and the importer absorbs the difference until pricing adjusts. This separation is extremely clarifying where margin and timing fail together.

Prepare a forecast showing when inventory is paid for, when customers pay, and when the funder withdraws money, since a larger import expense widens the gap before the goods produce receipts. And the goods must be paid for before the customer pays for them. A single container, repriced at the dock, can erase the margin on three months of payments. An import surcharge behaves like a tide in a harbor of fixed moorings: it lifts every cost around the payment while the payment itself stays chained to the dock.

The register shows sales. The account shows what sales kept.

Whether customers will absorb a higher price is a question the order book must answer. The business must earn the payment twice: once from the customer and once from the margin the shipment leaves behind.

A Settlement Review of the Revised Capacity

The revised capacity deserves an independent measure. Delancey Street offers a free confidential initial review of business debt concerns, and an importer facing higher landed costs can ask whether negotiation fits the capacity the revised figures allow. The company provides debt settlement services as a settlement company and coordinates legal matters with independent counsel, since it is not a law firm and not a customs adviser.

Confirm eligible accounts, fees, and the scope of assistance. Shipment specific duty questions belong with qualified customs assistance rather than with the debt review.

Borrowing for the Next Shipment

Borrowing for the next shipment answers the financing question with the revised figures or it answers nothing. A further advance may fund a more expensive order while adding another claim against its eventual receipts, so the full new obligation belongs in the calculation before approval is mistaken for capacity.

Resist the urge to justify new financing with the old margin assumption. Do not let the old margin into the new forecast, even briefly, as a placeholder. We price the purchase, add the financing cost, and test whether the combined plan leaves usable cash after every payment. The SBA description of 7(a) working capital and refinance uses includes working capital and qualifying refinancing through participating lenders, subject to eligibility and underwriting. No program should be treated as assured funding for the next order, and an extremely rapid approval can still be unsuitable if the schedule outruns the goods.

A lender that funded the last shipment has no duty to fund the more expensive one. Judge the next purchase by its own costs and its own collection date, since a brittle plan that snaps at the first revised invoice protects neither the inventory nor the MCA schedule.

Delancey Street provides an entry point for the settlement inquiry through its initial review. The margin, not the revenue, repays the advance, and a useful plan measures the revised economics before committing the next season of receipts.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
