8 Texas Exemptions That Protect You From a Personal Guarantee in Practice

A Texas personal guarantee meets constitutional and statutory barriers before it reaches most assets. Eight protections shape what a creditor can actually collect.

A signed guarantee does not convert every asset the guarantor owns into collection property. Texas interposes barriers between a judgment creditor and the guarantor, and those barriers decide cases more often than the contract language. The funder must sue, win, and collect within boundaries drawn long before the advance funded.

Current Wages and the Garnishment Bar

Texas closes the most direct route first. The constitution bars wage garnishment outside support obligations and stated exceptions, and the state law library guide names child support, spousal maintenance, student loans, and unpaid taxes among them. A funder holding a guarantee for ordinary business debt stands outside every category.

Current wages enjoy a separate statutory shield. Chapter 63 of the Civil Practice and Remedies Code separately exempts current wages from writs of garnishment. The objective is to ensure no exempt dollar is surrendered before counsel reviews the paperwork.

Deposited pay receives less shelter than pay still owed. A Texas writ still cannot take incoming wages, yet funds resting in a bank account can be frozen once the collector holds a judgment and a court order. Court rules require notice when a ruling freezes personal property, and property taken in violation can be pursued for return.

The Homestead and Its Acreage Measure

The homestead is exempt. It is also the asset collectors ask about first. Texas homestead law repays careful reading rather than confident summary.

The protection is, if we are being precise, measured in acres rather than dollars. The measure runs ten acres for an urban homestead, two hundred for a rural family, and one hundred for a single adult, with no dollar cap in the definition. The Texas homestead acreage definition confirms the structure, and the constitution separately shields the homestead from forced sale for most debts.

Other land receives no such treatment, and surplus acreage beyond the measure stands exposed.

Exempt Personal Property

Tools survive. Furnishings survive. The instruments of a trade survive. Chapter 42 of the Property Code exempts personal property categories from garnishment, attachment, execution, and seizure, including home furnishings and tools.

A carpenter keeps his tools when the creditor comes; the legislature decided long before the dispute that a trade survives its debts. Counsel can identify and segregate exempt items before the collector inventories them.

Simply list every furnishing, vehicle, and tool before the collector inventories them. We ensure the exemption claim reaches the court before funds move. The exemption keeps a household intact while the dispute proceeds, an extremely humane result from an unromantic chapter.

The Four Year Limit on Suit

Section 16.004 of the Civil Practice and Remedies Code sets a four year limitations period for Texas debt suits, and the Texas State Law Library collection guide confirms that an expired period ends the right to file. Four years sounds generous until it is not.

The suit the collector files, or declines to file, within the period decides whether the remaining exemptions ever come into play. Gather and organize the earliest demand letters, because the clock runs from facts the file may already contain. That is the part owners miss while negotiating payment on a debt no court has examined.

That, in brief, is the entire Texas posture: sue, win, and then collect within the boundaries the constitution drew first. The guide language is summary rather than statute.

Judgment Liens and Their Ten Year Life

After ten years, unless a government agency holds the debt, the lien expires. A Texas judgment lien against real property lasts a decade, an extremely slow clock.

The lien attaches, the homestead answers. Designated residence property may stand exempt, while other parcels remain reachable and a sale can divert proceeds to the creditor. Stale designations fail when the property changes hands.

A lien ages the way paint fades on a wall that faces the sun: slowly, and in full view of everyone involved. The owner who tracks the designation across sale and refinancing preserves what the forgetful owner loses.

Confession Terms Void in Covered Contracts

Since September 2025, one funding term has no effect in covered Texas contracts. Section 398.055 of the Finance Code declares confession of judgment provisions void and unenforceable, and the enrolled Texas commercial financing law pairs that prohibition with cost and broker compensation disclosures for specified offers under one million dollars.

The statute creates no private right of action, so counsel must pursue and protect the remedy through regulatory channels. Whether a given advance falls under the chapter is a question I cannot answer from this desk.

An outlandish assumption about what a signature conveys should not survive the first reading of the chapter. The disclosure duties alone change any negotiation over a covered balance, an extremely practical consequence of a statute owners overlook.

Retirement Benefits Under Federal Law

Federal law guards the pension even where state exemptions stop. Pension benefits under covered plans cannot be assigned or alienated except through stated exceptions such as qualified domestic relations orders. Exceptions exist, though most prove narrower than collectors suggest.

I have yet to see a plan administrator honor a funder letter, though such letters keep arriving. The administrator answers to federal statute rather than to collection correspondence.

When Collectors Call About Business Debt

Rarely does a collector volunteer which law governs the call. Federal protections cover specified consumer collection, and business debts fall outside that framework, a distinction the federal explanation of collector limits states directly. The absence of a federal validation right does not authorize deception, and counsel should assess the conduct under the laws that do apply.

Most buyers of defaulted paper know exactly what they purchased, and prefer not to examine it too closely. The collector recites the balance in order to anchor the negotiation, and any statement about the debt, even casually, can alter the posture of the case against the guarantor.

Resist the urge to promise payment on the first call. The exemptions above decide what a judgment can reach. This section decides what a voice on the telephone can demand. Delancey Street negotiates commercial balances as a settlement company, not a law firm, and its free confidential initial review can start while independent counsel measures the exemptions against the guarantee. Consultation is where this conversation begins. The guarantee signs away leverage; the exemptions keep the remainder.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
