Merchant Cash Advance Affiliate Programs
Disclosure, Compensation, and the Paid Referral

A paid referral carries the fingerprints of its compensation, so the owner should locate the disclosure, obtain the program terms, test any ranking against enforcement history, and supply the suitability examination the affiliate has no interest in performing.

A commission creates an interest in the recommendation before a single word of the recommendation is written.

Merchant cash advance affiliate programs compensate introductions, and the compensation can shape which provider appears first, which comparison favors the sponsor, and which risks receive attention. The referral deserves the same examination as the financing it promotes. The payment behind it is part of the document.

The Disclosure Obligation

The FTC guidance on endorsements explains that material relationships affecting the credibility of a recommendation should carry clear disclosure. Affiliate relationships can require disclosure, and the context of the message together with its overall impression determines what the audience understands. A commission that stays hidden converts advice into advertising without changing its costume.

Before relying on a referral, locate the statement of the commercial relationship and read it as the borrower it addresses. A disclosure buried on a separate page, rendered in extremely small type the eye skips, or worded to suggest independence where payment exists, fails at the only task disclosure performs. We would ensure the owner knows precisely where the statement appears and what it concedes.

Three referrals this spring alone arrived with identical language under different letterheads. The coincidence explained more than the rankings did.

The recommendation was sincere. It was also purchased.

Simply ask the referrer to state the compensation in plain terms: who pays, how much, and whether the amount varies by provider. An honest answer strengthens the referral. Evasion answers a different question than the one posed.

How the Compensation Works

And the structure of the payment predicts the shape of the advice.

A flat fee per funded introduction rewards volume without regard to suitability. A percentage of the advance rewards larger obligations over smaller ones. A recurring share of collections extends the interest past funding and into the life of the debt. Each form is lawful in itself. Each form leans on the recommendation in a distinct direction, and the lean is rarely disclosed alongside the praise.

There is a particular confidence in a conference room when the introducer describes the process as seamless. The word deserves scrutiny in proportion to the smoothness it promises.

Obtain the program terms as the referrer received them, not as the landing page summarizes them. A summary offered over the telephone, even briefly, is not the terms. The agreement between the affiliate and the provider is the document that governs the referral, more than any review the affiliate publishes. We would ensure the owner reads the compensation clause before reading the testimonial.

Steps taken, or not taken, before the introduction determine whether the borrower meets a matched provider or merely the highest bidder for attention. Resist the urge to treat the introduction as the diagnosis.

Rankings and Comparisons

In 2022, the FTC imposed a permanent industry bar on two MCA providers and an individual owner following charges of deceptive seizures from small businesses, as described in the federal enforcement announcement. A ranking compiled before that order, or one that never accounted for it, measures marketing persistence rather than provider conduct. The date of the comparison belongs beside its conclusion.

A ranking that cannot name its compensation is not a ranking. It is a menu printed by the kitchen it recommends, and the prices it quotes are the ones its sponsors approved.

Test the comparison against facts the sponsor cannot supply. Reconciliation behavior, litigation history, and the treatment of defaulting accounts rarely appear in affiliate content, though they decide more outcomes than the extremely rapid funding the content celebrates. The absence is structural rather than accidental, and the structure serves the party that paid for placement.

Whether a comparison site would publish the same order without payment is a question the site itself should answer before the borrower relies on it.

The criteria deserve a slower reading than the conclusion. The engagement that follows a ranking inherits every interest the ranking concealed, and the inheritance is judged by a single ledger rather than by the stars beside a name.

Suitability and the Referral

But the deeper defect is not bias toward one provider. It is indifference among all of them.

A referral compensated per funding has no reason to ask whether the business needs financing at all. The diagnosis belongs before the introduction, and the affiliate has no interest in performing it. The owner should supply the missing examination.

List the obligations. Note the receipts. Decide the question first.

Reading a Referral as a Document

Most owners treat the referral as advice and the agreement as the document. Reverse the assignment.

The referral carries the fingerprints of its compensation in word choice, in emphasis, and in the risks it declines to name. I have yet to see a paid comparison that lingered on default provisions, though default is the provision that governs when the optimistic forecast fails. Read it the way opposing counsel would read it, which is to say against the party that drafted it, and in order to find what it was drafted to withhold.

In most of the referrals we have examined, though the sample is not scientific, the disclosure language was accurate in isolation and misleading in placement. The guidance does not prescribe every format, which is part of the difficulty. Precision in wording cannot rescue a statement the reader never encounters.

We review the referral, identify the interests behind it, and construct a reading that treats the marketing as evidence rather than advice.

Delancey Street is a settlement company, not a law firm. It offers a free confidential initial review of existing MCA obligations, and it coordinates with independently licensed counsel where legal work is required. The review examines the debts themselves rather than the marketing that produced them. Consultation is where this conversation begins.

Frequently Asked Questions

Business debt settlement involves negotiating with commercial creditors to accept a reduced lump-sum payment. A professional firm works with your MCA funders, equipment lenders, and vendors to settle debts for 40-60% less than owed. The process typically takes 3-18 months with attorney-led firms.

Businesses typically resolve debt for 30-60 cents on the dollar. After fees (15-25%), net savings range from 20-40%. Attorney-led firms achieve higher reductions due to litigation leverage.

Settlement can temporarily impact credit, but most businesses pursuing settlement are already behind on payments. The goal is eliminating unserviceable debt so you can rebuild from a clean baseline. Most scores recover within 12-24 months.

Attorney-led firms like Delancey Street settle in 3-9 months. General firms take 24-48 months. MCA settlements move faster because funders prefer quick recovery over protracted litigation.
