NJ Federal Tax Evasion Defense Lawyers

26 U.S.C. Section 7201 is the well-known federal offense that strikes fear into the heart of individuals and businesses alike. It’s more simply known as tax evasion by the non-legal citizen, but anyone that’s ever paid taxes will tell you that this is one violation they never want to be charged with. It’s a criminal offense with steep penalties.

Reporting Taxes to the IRS

Citizens who earn money in the United States must report their taxes to the IRS each year. To do so, they must follow the rules and regulations set forth by the tax code in this country. NJ taxes are separate from federal taxes, but if you’re a NJ resident, you will reside in New Jersey when you’re charged with this federal crime. New Jersey lawyers at the Spodek Law Group are experts in tax law and capable of defending you against charges.

Tax reporting is tricky. The average citizen doesn’t know the complex rules and regulations set forth in the United States code. Many people today also report taxes using tax software, and sometimes things can go wrong with the system or with general reporting. It’s sometimes easy to make a mistake and underreport taxes. If it’s a minor issue, you can sometimes simply pay back taxes and then continue.

However, if someone has intentionally hidden income, this is a different matter. Tax evasion itself is described as an “attempt to evade or defeat tax.” Anyone accused of this crime could face years in prison and financial penalties.

Tax Evasion Investigations

Federal tax evasion cases are investigated by the Criminal Investigations Division of the IRS. They consider tax evasion to fall under 7201. It states:

“Any person who willfully attempts in any manner to evade or defeat any tax imposed by this title or the payment thereof shall, in addition to other penalties provided by law, be guilty of a felony and, upon conviction thereof, shall be fined not more than $100,000, or imprisoned not more than 5 years, or both, together with the costs of prosecution.” Corporations can be fined up to $500,000.

If you’re under investigation for tax evasion, chances are you’re already under much stress. The penalty could include prison time, and no one under investigation for this serious crime should ever try to defend themselves or explain themselves to the IRS. You need a lawyer to work on your behalf at all stages of the investigation.

NJ Federal Tax Evasion Defense

At the beginning of the investigation, don’t make the mistake of trying to explain yourself or send as much as one document without first consulting a lawyer. You don’t know the complex federal tax code, but the lawyers at Spodek do. We can help you avoid disclosing information that you’re not obligated by law to disclose. These “unnecessary disclosures” can ruin you life in a hurry and hurt your chances of beating the case later on.

Our team is wholly dedicated to representing our clients accused of tax evasion. This serious crime can cause many lifelong consequences if you’re convicted. Our job at every stage is to give you a fighting chance to be a very tough crime to beat. Without a good lawyer on your side, you’re going to make many errors during your case. This is one charge we can say with 100% certainty you shouldn’t try to represent yourself in. Federal investigators are smart and trained to make sure you get a fine and prison sentence from the charge. Don’t let them win.

Your defense lawyers will focusing on showing that you did not willfully underpay federal taxes. There are many lines of defense that we can use, but overall, we want to show that you are not guilty of the crime of “willfully” underpaying your taxes. In many of the cases we see, this is true. The person simply isn’t guilty of tax evasion.
