How Long an MCA Judgment Follows You
Renewal Under New York Rules With Other State Records Checked Separately

An old judgment is not a dead judgment. Age alone settles nothing about which rights remain enforceable against the owner.

A New Jersey merchant holding a New York MCA judgment may hear that ten years ends the matter, yet the judgment, the county lien, and any renewal action run on separate clocks under separate rules, with an extremely long tail the demand letter does not show. Because only the docket reveals which clock is running, the owner should read the record before trusting the calendar.

Dates That Measure Different Rights

Collect the entry date, the first docketing date, and the filing date of the judgment roll, and keep the three distinct. Later orders, county filings, and payments each create their own markers, and a demand letter that cites one date leaves the others unexplained. The judgment endures. The lien may not.

That distinction decides which demands deserve an answer. Suppose the transcript reaches a second county eleven days after entry. That filing starts a local story the original docket does not tell, which is why counsel needs the papers from each location rather than a summary of the most recent letter.

Preserve every satisfaction document alongside the payment history. The age of the judgment does not answer the balance, and the balance decides whether any expiration theory matters at all.

The New York Renewal Framework

New York CPLR 5014 on actions upon money judgments permits an action upon a New York money judgment between the original parties where ten years have elapsed since first docketing, with suit allowed during the year before expiry, with separate treatment for default judgments entered without specified personal service and for actions authorized by court order. The resulting judgment under that procedure carries lien effect measured from ten years after the first docketing, a sequence counsel must verify rather than assume.

An owner who treats silence as expiry invites surprise, because a renewal complaint can arrive in the tenth year with its own response deadline, its own proof of service, and its own caption that looks unfamiliar until counsel places it beside the original file, where the connection becomes plain and the time to respond has begun to run.

A renewal action works the way a smoke detector works in a stairwell the owner stopped using: present, functional, and noticed only when it sounds.

Rarely does a creditor abandon a docketed judgment without a reason the file can show. Do not treat the absence of recent letters as proof that no new action was filed. Whether renewal suits in a given county run on schedule is a question the local docket answers better than any statewide assumption.

The Real Property Lien Period

New York CPLR 5203 on judgment liens against real property gives a docketed money judgment lien effect against the debtor real property in that county until ten years after filing of the judgment roll, subject to stated exceptions, with extension ordered by the court available for specified periods on noticed motion. The lien clock and the enforcement clock are different instruments.

Identify the county, the property interest, and any extension order with its filing information. A judgment docketed in one county should not be assumed to burden property everywhere, and a planned sale or refinance makes the question immediate in a way correspondence does not.

You stop watching the docket and then the docket decides the closing. The title search will find it.

Other State Records as Separate Work

A New York judgment may seed a record in another state, but renewal, recognition, and enforcement there follow local procedure, an extremely local question no New York date can answer. Obtain the foreign filing, the notice, and any resulting order, and preserve the service information with the party names as entered there. I have watched closings stall over dockets older than the associate who found them.

Counsel should trace and map how the local record relates to the New York judgment, at least on the papers counsel has been able to retrieve. Do not fill missing dates with a national average the research did not supply.

Whether the destination court would extend, renew, or limit the domesticated record on facts like these is a question no general article can answer.

Recording the End

But the owner need not read the calendars without help. The record rewards the punctual reader. Early readers set the terms.

Delancey Street can review the MCA obligation through its merchant cash advance settlement service, which offers a free confidential initial review. Bring the judgment history rather than only the original agreement, so the discussion covers the renewal posture and every related filing in the case against you. Early preparation decides what the review can accomplish.

The company is a debt settlement company, not a law firm. Independently licensed counsel handles representation and the analysis of renewal, lien duration, and other state proceedings, and the objective is to ensure the correct records are searched and retrieved and to ensure any resolution names each judgment it ends. Counsel should confirm the result in writing before the owner acts on it. The lien that survives renewal is a brittle thing to discover at a closing table, so confirm the docket before promising a date.

The steps the owner takes, or does not take, as the tenth year approaches will decide whether renewal helps settlement or helps the creditor. Simply assemble the chronology with the executed agreement and the resulting court documents. Resist the urge to transfer property on the strength of an expiry theory, even briefly discussed among partners, since the funder renews in order to preserve the very claim the owner assumed had faded.

The question was not whether the judgment feels old. It is which rights remain, and what documented act will end them.
