What Now
Foreign Judgment Filed Against You in Texas, Florida, or California From a New York MCA Case
A New York judgment filed in another state creates a new record with new deadlines. Debtors should assemble both files, fix the receiving state clock from the docket, and place every objection through counsel.
Attorney-founded MCA defense firm serving businesses nationwide. Freezes daily ACH withdrawals, challenges confessions of judgment, removes UCC liens, and negotiates settlements at 40-60% reduction.
The case is over. It has just begun in a second courthouse.
A New York MCA judgment filed in Texas, Florida, or California creates a new record with new deadlines, and the first date to establish is the one that starts the receiving state procedure. That date may be the recording date, the service date, or the mailing shown in the court file, rather than the day the owner learned enforcement had moved. Most owners call after the bank freezes the account. I understand the order of events.
The Response Clock Belongs to the Receiving State
Assemble the New York judgment and the new filing as separate records, with every notice and envelope in one folder. A domesticated judgment arrives the way winter arrives in a rented house. The lease never mentioned it, and the pipes freeze just the same.
Confirm the debtor named in each document, since a company judgment and an individual judgment reach different property. Compare the new filing amount against the original judgment with subsequent payments. That is the cost of treating a court paper as correspondence: the paper keeps its own arithmetic regardless of who reads it.
Gather and give counsel any appeal, stay, or satisfaction documents from the New York matter at the start.
Texas: Notice of Filing and the Stay Showing
A filed New York judgment in Texas carries the effect of a judgment of the filing court, with the same defenses and proceedings. Under the Texas provisions for judgments of other states, that parity is the debtor shield as well as the creditor sword, and counsel tests both edges on an extremely tight timetable.
The debtor should have received mailed notice of the filing, since the creditor must mail notice to the affidavit address and file proof of mailing for the docket. If no notice arrived, tell counsel at once with the address history in hand. Rarely does the affidavit address match the mailbox the debtor checks today. Clerks tend to docket the creditor proof on receipt, and a call to the clerk window answers the filing date faster than any website.
Stays remain available for a pending or approaching New York appeal with the required sister state security, and for any ground that would stay a Texas judgment with the security Texas requires. Bring the appeal papers, any stay order, and the payment record to the conference.
The creditor option to sue on the judgment instead stays live beside the filed judgment.
Florida: Recording, Mailed Notice, and the Contest Action
A recorded New York judgment in Florida carries Florida defenses with Florida proceedings. Nothing can issue for thirty days after the clerk registered mail notice, and no lien exists before then. The notice, if we are being precise, is the clerk mailing rather than any letter the creditor sent on its own, though a creditor mailing with recorded proof cures a clerk failure.
Within thirty days after recording, the debtor may file an action contesting the rendering court jurisdiction or the validity of the judgment and record a lis pendens directed toward it. Under the Florida contest provisions for foreign judgments, the court must stay enforcement and the lien upon that filing. The recording date starts the contest clock, while the enforcement wait runs from the clerk mailing. A debtor who merges those dates misunderstands the time available.
A broader stay remains available on any Florida ground, with like security. Limitation defenses survive, since the act changes no limitation period. Other defenses require a showing few debtors can make without records.
Resist the urge to answer the creditor objection letter as if it were the contest action. You have thirty days from recording, and the clock honors filings rather than correspondence, with extremely little patience for confusion between the two. A filed foreign judgment collects while the debtor researches. That is the design rather than an accident of it. Creditors choose these routes in order to shorten the distance between judgment and collection.
California: Served Notice and the Motion to Vacate
The Judicial Council notice must tell the debtor of the thirty day window to move to vacate. Under the California vacatur provisions for entered judgments, the motion comes within thirty days after service, on written notice to the creditor, on any defense to a California action on the judgment, including incorrect interest math. The court may vacate and enter a different judgment, even one for the creditor in a corrected amount.
Review the application accounting alongside its notice. Identify the unpaid amount, the included interest with rate and citation, and the basis counsel can test. Where payments followed the judgment, supply dates with confirmations.
Enforcement waits at least thirty days after served notice, outside narrow exceptions. Under the California stay provisions for entered judgments, the court grants a stay where a New York appeal pends or remains available, where a New York stay operates, where the vacatur motion pends, and where the interests of justice require it, on terms the court finds just. A stay can pause enforcement without resolving the merits.
The proof of service sits in the file. Ask counsel to read it.
Negotiation Apart From Procedural Protection
A creditor may discuss settlement while the debtor weighs legal relief. Any statement in those talks, even casually, can narrow the defenses counsel planned to raise. That discussion should never be mistaken for a stay, an extension, or a completed objection, and a singular cruelty of the thirty day clocks is their indifference to productive conversation.
Delancey Street offers an initial review of MCA settlement possibilities through its business debt settlement service. The company is a settlement company, not a law firm, and its commercial role stands distinct from representation by independently licensed counsel. Delancey Street ensures the payment proposal states the amount, the credit for prior transfers, and the interest treatment through the payment date. Independent counsel ensures no deadline passes unaddressed while the proposal moves forward. Simply confirm scope and fees, and review and test the accounting before any transfer.
A proposed settlement should address both judgments on the record. Ask counsel what release or satisfaction the file requires, then preserve the confirmation. The envelope that started this matter deserves a place in the folder beside the order that ends it.
